The Public Defender Division of the Committee for Public Counsel Services, the public defender agency of Massachusetts, seeks a superior and district court practitioner for a Trial Attorney position in the Brockton Office, located in Plymouth County. CPCS provides legal representation and zealous advocacy to the indigent community. AGENCY OVERVIEW CPCS is the state agency in Massachusetts responsible for providing an attorney when required to represent a person who cannot afford one. The agency provides representation in criminal, delinquency, youthful offender, family regulation, guardianship, mental health, sexually dangerous person, and sex offender registry matters, as well as appeals and post-conviction and post-judgment proceedings related to these matters. The clients we represent are diverse across many dimensions, requiring cultural competence and the ability to work with people of varying races, ethnicities, genders and/or sexual orientation identities, abilities, and limited English proficiency. OFFICE OVERVIEW The Brockton Office provides public defense services in Plymouth County and is located on Main Street in Brockton. Attorneys represent clients in the Plymouth and Brockton Superior Courts and in the four District Courts in the county: Plymouth, Brockton, Hingham, and Wareham. The office includes Trial Attorneys, Investigators, Social Services Advocates, and Administrative Assistants. POSITION OVERVIEW The Public Defender Division seeks an experienced superior court practitioner to provide criminal defense representation in Plymouth County. The Trial Attorney will represent clients in the Superior and District Courts and may handle interlocutory appeals, civil commitments, witness testimony before the grand jury or trial court, and certain collateral matters as permitted by a supervisor. The caseload is expected to be predominantly serious Superior Court matters. The attorney may act as an informal mentor to other staff attorneys in the office. RESPONSIBILITIES Interviewing clients Arraignment and bail advocacy Legal research and writing Pretrial investigation, including visiting crime scenes, locating and interviewing witnesses, and reviewing documentary evidence Preparing and arguing pretrial motions, affidavits, and legal memoranda Dispositional investigations and advocacy Jury and bench trials of criminal cases Litigating cases in the Superior Court and the District Court Representing witnesses before the grand jury or trial court Representing clients in interlocutory proceedings Collaborating with private attorneys on cases assigned through the Private Counsel Division of CPCS where appropriate Other duties as assigned MINIMUM ENTRANCE REQUIREMENTS Committed to serving a culturally diverse, low-income population and eligible to practice law in Massachusetts, either as a member in good standing of the Massachusetts bar or as a member of another jurisdiction eligible to engage in limited Massachusetts practice under Rule 3:04 Access to an automobile to travel to courts, clients, and investigation locations not easily accessible by public transportation Access to a personal computer with home internet sufficient for remote work QUALIFICATIONS/SKILLS Candidates should possess the following attributes for the position of Trial Attorney: Significant experience as lead counsel on jury trials and evidentiary motions in the Superior Court (or equivalent) for at least three (3) years A demonstrated commitment to zealous advocacy for indigent criminal defendants A demonstrated commitment to CPCS values A commitment to continuing legal and organizational training Strong interpersonal and analytical skills Ability to work independently and collaboratively in a criminal defense environment Foreign language skills to support interaction with limited English proficient groups are desirable but not required HOW TO APPLY To apply, please supply a resume and a personal mission statement of no more than two pages detailing your interest in the position, personal qualities, background, and skills, and what you hope to achieve in this work.
