Attorney 2 – West Virginia State Tax Division Position Type : Full-time, mid-level.

Location: Kanawha County, Charleston, WV.

Job Summary The West Virginia State Tax Division seeks a full-performance level attorney (“Attorney 2”) to provide legal advice and representation for the agency. The attorney will represent the division and the Tax Commissioner before the West Virginia Office of Tax Appeals on taxpayer petitions for refund and reassessment and may also represent the agency on property tax valuations.

Responsibilities

Provide legal research and writing of briefs, rulings, and advisory letters in response to requests from taxpayers, government entities, and other stakeholders.

Represent the division in administrative hearings, including preparation and presentation of evidence before the West Virginia Office of Tax Appeals and other administrative tribunals.

Assist in drafting legislation, rules, and policy to implement changes in tax code, and review, analyze, and comment on proposed legislation and regulations.

Handle correspondence and written responses to other government agencies, law firms, accounting firms, and non‑state entities on tax‑related issues.

Work with senior attorneys on complex litigation and advanced tax matters once proficiency is achieved.

Perform related duties as required, which may include intermittent travel; a valid driver’s license is required.

Qualifications

Admission to the West Virginia State Bar.

Two years of full‑time or equivalent part‑time paid employment in the practice of law.

One year of full‑time or equivalent part‑time paid employment as an attorney with a state agency may be considered equivalent to the two‑year requirement.
