The Employee Relations Manager works under the direction of the Corporate HR Director at Austin Industries, Inc. ("Austin Industries") to coordinate and direct employee relations programs and activities for Austin Industries and its subsidiaries and affiliates (collectively, "Austin") to ensure that Austin is in full compliance with applicable laws and regulations. Additionally, the position works closely with the Austin’s Corporate Counsel and HR Directors at each subsidiary of Austin Industries (Austin Commercial, Austin Bridge & Road, and Austin Industrial) in developing, implementing, and evaluating ongoing Human Resources ("HR") policies, practices, procedures, programs, and activities that have a positive impact on employee relations. The Employee Relations Manager also serves as an Open Door Facilitator for the Austin Open Door program. Responsibilities: Collaborates and coordinates with the Corporate HR Director, the applicable Company HR Director, the legal department, and other members of management, as applicable, throughout internal investigations. Provides regular updates regarding internal investigations to the Corporate HR Director and the legal department. Provides quarterly updates to company Presidents, as requested. Provides consultation and guidance to supervisors and management in the performance improvement process; works with supervisors and management to address performance concerns, including, without limitation, drafting and/or reviewing of performance documentation, reviewing and providing input for performance appraisals, and assisting supervisors and management with providing performance feedback. Responds to inquiries from employee-owners regarding employment-related policies, practices, procedures, and programs. Identifies and resolves employee relations issues in a manner consistent with Austin's policies, practices, procedures, and programs, as well as applicable laws and regulations. As an Open Door Facilitator, manages and oversees the Austin Open Door program; assists with the implementation of the Austin Open Door program by, without limitation, ensuring that employee-owners are aware of and sign off on the Open Door policy; answers questions about Austin Open Door and assists employee-owners in identifying supervisors or managers at appropriate levels of the company to assist in resolving the employee-owner's dispute. Investigates and responds to complaints made via the Austin Open Door hotline; may investigate and respond to employment-related complaints not raised via the Austin Open Door hotline, including, without limitation, complaints related to potential violations of Austin's employment-related policies, practices, procedures and/or programs, potential violations of applicable labor and employment laws or regulations, and potential unethical behavior and/or misconduct related to employee-owners. Documents investigative interviews and collects, protects and retains pertinent information and documentation related to investigations; drafts reports on investigations; recommends and initiates appropriate steps for resolution, including, without limitation, consistent and appropriate corrective and preventative actions as needed. Assists with the collection of relevant information and documents related to employment-related litigation, arbitration or administrative matters (including, without, limitation, audits, investigations, complaints and/or charges before federal or state agencies such as the Equal Employment Opportunity Commission ("EEOC") or Texas Workforce Commission ("TWC"); serves as a liaison between supervisors/management and the legal department with respect to employment-related litigation, arbitration or administrative matters; may assist the legal department in investigating and/or drafting a response to allegations raised in employment-related litigation, arbitration or administrative matters. Collaborates with management and Human Resources on the development and review of supporting documentation for all involuntary separations. Evaluates labor and employment policies for compliance and effectiveness; recommends and assists with revisions in coordination with leadership and legal. Ensures compliance in required time frame with respect to various HR activities, including, without limitation, providing responses in timely manner to subpoenas, claims for unemployment benefits, and appeal hearings to contest benefits requested by former employee-owners. Develops and conducts various compliance and training programs as necessary. Provides backup administrative support to HR as needed, particularly, with respect to special projects or when assistance is needed to meet mandatory deadlines. Travels to visit customer sites and Austin offices as needed. Performs other job-related duties as assigned. Qualifications: Able and willing to face challenges with energy and composure while producing results and effectively managing conflict. Able to prioritize tasks and projects effectively, with excellent time management, organization, and prioritization skills to accomplish desired results. Strong analytical skills, demonstrating an ability to capture, analyze and interpret large amounts of HR-related data. Capable of maintaining confidential information and providing requested information to support functions on a need-to-know basis. Ability to resolve conflicts in a high-stakes environment. PHR, SPHR, SHRM-CP or SHRM-SCP certification preferred. Requirements: Bachelor's degree Human Resources or relevant field required. Six years of professional Human Resources experience, including at least four years in which Employee Relations was a significant part of the responsibility An equivalent combination of education and experience may be considered. Ability to obtain a Transportation Worker Identification Credential (TWIC) card for access to customer sites required. Proficient in Microsoft Office Suite (Word. PowerPoint Excel). Strong knowledge of applicable employment law. Strong presentation skills and communication skills. This position requires travel to various project sites and/or office locations throughout the United States. The yearly average travel is about 25%.
