As a Patent Litigation Associate at PKH, you will work on complex and high-stakes cases involving cutting-edge technologies. You will have the opportunity to handle substantive aspects of litigation, from early case strategy through trial and appeal, as well as participate in contested proceedings before the U.S. Patent and Trademark Office. Key Responsibilities
Case Management:
Take responsibility for and assist in all stages of patent litigation, including drafting and responding to pleadings, motions, and discovery; preparing for and attending hearings; and supporting trial teams. PTAB Proceedings:
Handle post-grant proceedings before the Patent Trial and Appeal Board (PTAB), including inter partes review (IPR), post-grant review (PGR), and covered business method (CBM) proceedings. District Court Litigation:
Actively participate in federal district court patent litigation, including managing discovery, depositions, claim construction (Markman) briefing, and motion practice. Legal Research & Analysis:
Conduct in-depth research on complex patent law issues, including validity, infringement, enforceability, and damages. Client Communication:
Maintain strong client relationships by providing clear legal advice, case updates, and strategic recommendations. Court Appearances:
Represent clients in federal courts and before administrative bodies, including the USPTO and PTAB. Collaboration:
Work closely with other attorneys, paralegals, and staff to drive successful case outcomes. Business Development:
Support client development efforts, including networking and expanding relationships. Qualifications
Juris Doctor (JD) degree from an accredited law school. Admission to the bar in Georgia or another suitable jurisdiction. Minimum of 2 years of experience in patent litigation with demonstrated involvement in one or more of: PTAB proceedings (IPR, PGR, or CBM); federal district court litigation, including claim construction briefing and hearings; and managing discovery, including written discovery, document productions, and depositions. Strong understanding of patent law and litigation procedures. Excellent written and oral advocacy skills. Exceptional research and analytical ability. Ability to work independently and as part of a team. Strong work ethic and dedication to client service. Preferred Qualifications
Experience with patent prosecution or portfolio management. Technical background in engineering or the sciences. Prior trial experience in district court or before the PTAB. Experience in client development and marketing. How to Apply
