The Opportunity This position works out of our Pleasanton, CA location in the Heart Failure Division. Abbott is seeking an experienced commercial attorney to provide legal advice to Abbott’s Heart Failure Division. The attorney will identify and resolve complex legal issues to support operations of a global leader in research, development, manufacturing, sales and marketing of medical device products. The ideal candidate will have experience with healthcare providers and a solid understanding of payor agreement contracting principles, billing, reimbursement, compliance and auditing guidelines. Familiarity with regulations governing DMEPOS or IDTFs is preferred. What You’ll Work On

Conduct reviews and revisions of payor agreements and offer legal advice on business payor relations and contracting strategies. Provide legal guidance on DMEPOS and IDTF operations and related standards, including billing, reimbursement, auditing, and compliance programs. Advise on payor and reimbursement disputes to mitigate legal risks. Draft, negotiate and review a wide range of agreements (procurement, sales, licensing, marketing, co-promotion, research collaborations). Review marketing programs and promotional materials for compliance with FTC principles, Abbott policies and applicable law. Provide practical and timely legal advice on matters related to operation of a commercial business that markets to health care professionals. Resolve legal issues using negotiation and legal expertise, including pre-litigation dispute resolution and settlements. Assist in creating template agreements, playbooks and training to support contracting processes. Develop knowledge of Abbott’s businesses, products and client areas. Maintain familiarity with laws affecting client areas, including sales and marketing of products to health care professionals and reimbursement by government programs (e.g., Anti-Kickback Statute, False Claims Act, Stark, HIPAA, FDA, and FCPA considerations). Represent Abbott externally to suppliers and customers; assist in selecting and directing outside counsel as needed. Interact with multiple Abbott departments and coordinate cross-functionally. Occasional travel may be required (approximately 10–15%). Critical Success Factors

Required Qualifications

Juris Doctor degree from an accredited law school and admission to a US state bar in good standing. 3+ years of experience as a commercial attorney at a top law firm and/or in-house. Preferred Qualifications

Experience in regulated industries and working with healthcare providers. Strong understanding of payor contracting principles, billing, reimbursement, compliance and auditing guidelines. Familiarity with DMEPOS or IDTF regulations. Ability to manage multiple projects in a fast-paced environment with sound commercial and legal judgment. Ability to handle complex matters independently and know when to elevate to senior management. Excellent interpersonal, strategic thinking, communication and organizational skills.
