We are an enterprising personal injury law firm that is on track for aggressive growth, and we need an experienced Personal Injury Litigation Attorney to join our team, working directly with the owner to support the team and help our clients.
We love to help people learn and grow. We need a Pre-Litigation Attorney with experience in personal injury. The ideal candidate will be able to take initiative on work that needs to be done and complete tasks with minimal hand-holding. We want to be known for helping clients come out of an extremely emotional process feeling as though they are a better person, in a better position, and that they had a team behind them that really cared and fought for them. We are growing fast, and we need a prelitigation attorney who can hit the ground running.
This is a full-time position where you are expected to manage a caseload, so you absolutely must be able to work remotely for 40 hours per week.
Initial employment compensation will be based on your experience, with opportunities for increases after that. There is an opportunity for bonus compensation for those who can demonstrate their profitability.

Pre-Litigation Attorney Responsibilities
Client Consultation & Intake Meet with new clients to review case details and perform initial case evaluations. Assess the merits of the claim, explain the legal process, and outline the next steps. Gather initial documentation such as police reports, photos, and medical records.
Case Investigation & Evidence Development Conduct comprehensive fact-gathering, including accident reports, medical treatment history, and witness interviews. Coordinate with investigators, accident
reconstructionists,
and medical experts to build a strong liability and damages narrative. Identify potential defendants and insurance coverage early in the case.
Medical Treatment Coordination Guide clients through the medical treatment process, ensuring they receive appropriate care. Monitor treatment progress, obtain updates from providers, and secure complete and accurate medical records and bills.
Legal Research & Analysis Analyze applicable statutes, case law, and insurance policy provisions relevant to the claim. Evaluate liability, causation, and damages to determine case value and strategy.
Demand Preparation Draft comprehensive demand letters detailing liability, injuries, medical treatment, and damages. Include supporting documentation such as medical records, bills, photos, and expert reports. Calculate economic and non-economic damages to maximize recovery potential.
Settlement Negotiations Communicate with insurance adjusters and opposing parties to negotiate settlements before litigation. Present case strengths, counter low offers, and pursue policy limits when appropriate.
Client Communication & Education Maintain regular contact with clients, providing updates and answering questions. Educate clients on treatment, settlement expectations, and the timeline of the pre-litigation process.
Legal Strategy & Case Management Develop case strategies aimed at resolution without litigation while preserving leverage for potential suit. Track all case deadlines, statutes of limitations, and lien resolution issues. Manage a high-volume caseload efficiently, using case management software to keep files organized.
Collaboration with Team Work closely with case managers, paralegals, and administrative staff to ensure timely and accurate case progression. Escalate cases to litigation when settlement efforts are unsuccessful and prepare files for smooth transition to the litigation team.
Ethical Compliance & Professional Development Uphold all ethical obligations, including client confidentiality and compliance with state bar rules. Stay current with changes in personal injury law and pre-litigation best practices through continuing education. Qualifications:
Education: Juris Doctor (JD) degree from an accredited law school. Admission to the state bar and in good standing with the relevant jurisdiction.
Experience: A minimum of 5 years of experience practicing law, with a focus on personal injury prelitigation. Proven track record of successful case outcomes in personal injury matters. Experience in all phases of litigation, from initial client consultation to trial.
Skills: Excellent legal research and writing skills. Strong negotiation skills for settlements. Ability to conduct comprehensive case investigations. Proficiency in drafting legal documents such as complaints, motions, and settlement agreements. Trial experience and the ability to effectively represent clients in court. Knowledge of relevant laws, regulations, and legal precedents in the field of personal injury.
Communication: Exceptional communication skills, both written and verbal. Ability to explain complex legal concepts to clients in a clear and understandable manner. Strong interpersonal skills for effective client interaction and relationship building.
Analytical and Strategic Thinking: Analytical mindset with the ability to assess the strengths and weaknesses of a case. Strategic thinking to develop effective legal strategies. Problem-solving skills to navigate challenges during the litigation process.
