Job Summary This position is located in the Office of the Inspector General (OIG), Operations Division, Medicaid Fraud Control Unit (MFCU). The MFCU is responsible for investigating and prosecuting (or referring for prosecution) cases involving health care fraud by District Medicaid providers and abuse, neglect, or financial exploitation of District Medicaid beneficiaries. The position functions as an Attorney-Advisor in the MFCU and as a Special Assistant United States Attorney (SAUSA) in the District of Columbia United States Attorney’s Office (DC USAO) upon completion of appropriate training. As a SAUSA, the incumbent is responsible for prosecuting MFCU cases during criminal proceedings, including arrests, indictments, grand jury presentations, trials, etc. The incumbent is responsible for providing legal advice and prosecutorial guidance to the MFCU investigative team during investigations and criminal proceedings. The incumbent will be prosecuting MFCU cases in the D.C. Superior Court or District Court for the District of Columbia. Duties And Responsibilities

Works closely with the MFCU investigative staff to keep investigations progressing toward completion and prepares staff to testify on the results and findings of their investigations in presentations to the DC USAO as well as grand jury presentations and trials. Prepares and prosecutes criminal financial fraud Medicaid cases as well as criminal abuse, neglect, or financial exploitation cases relating to Medicaid beneficiaries. Reviews subpoenas, search warrants, affidavits for arrest warrants, and ensures all written work product is well-written, accurate, and grammatically correct before forwarding the written work to supervisors or courts. Conducts preliminary/pre-charging analyses of MFCU cases involving suspected health care fraud by Medicaid-funded medical/health care providers for possible criminal prosecution by DC USAO; handles intake/papering duties and all post-arrest phases of MFCU matters, including discovery, additional investigation, grand jury presentations, plea negotiations, trial, sentencing, etc.; and compiles data and tracks the progress of all MFCU matters. Is the lead in all oral presentations made in connection with a criminal case, including grand jury proceedings and court appearances, etc.; presents to DC USAO supervisors and managers, as well as MFCU staff, supervisors, and managers. Makes formal presentations at conferences upon request of MFCU management. Keeps MFCU and OIG management as well as key stakeholders apprised on the progress and status of all assigned cases/legal work. Performs other related duties as assigned. Licensure and Certification The incumbent must have a law degree and be a member of the DC Bar or eligible for waiver into the DC Bar. (If eligible for a waiver, the incumbent must successfully obtain admission to the DC Bar within 360 days of commencing employment at OIG), plus a minimum of three (3) years of legal experience practicing law in an area closely related to the activity of the MFCU. The incumbent must successfully complete training at the DC USAO and must be appointed as a SAUSA by the United States Attorney for the District. Work Environment Work is typically performed in an adequately lit and climate-controlled office setting. Some travel may be required. OIG employees serving in Excepted Service positions serve at the pleasure of the Inspector General or designee. Domicile Requirement Excepted Service appointees must either be a District resident at the time of their appointment or become a District resident within 180 days of their appointment date.
