Objectives Summary: The objective summary for this job classification is to provide professional legal services for the Law Offices of the Public Defender in representing juvenile and adult indigent clients in areas of litigation, appeal, counsel, research and analysis.
Pay and Work Arrangements This position qualifies for an additional hourly pay differential of $0.76 hourly / $1,580.80 annually. Hourly pay differential reflects a retention pay incentive, as applicable to the position advertised.
Our department offers flexible work opportunities, including teleworking (a.k.a. working from home) and work schedules outside the typical 8 am to 5 pm schedule. Here’s what the New Mexico Law Offices of the Public Defender is looking for: Attorneys committed to advocating on behalf of indigent clients; attorneys interested in positively impacting the lives of clients through holistic representation; attorneys who can stand up for a client and stand up to “the system”; attorneys excited about gaining courtroom and litigation experience with familiarity with state statutes and rules of evidence and trial practice.
Compensation and Classifications Public Defender 2 (PD2) – Average Pay: $32.39/hour / $67,371.20 annually
Public Defender 3 (PD3) – Average Pay: $46.03/hour / $95,742.40 annually
Public Defender 4 (PD4) – responsibilities include felony cases; appellate workload; guidance to lower levels; independent work; ongoing professional development.
Incumbent will be considered for a Public Defender 2, 3, or 4 classification. Classification will be determined at the time of hire based on applicant's job-related qualifications and agency critical need.
Essential Functions
Public Defender 2 (PD2)
Handle a variety of misdemeanors and may assist in juvenile and youthful offender cases.
May assist higher level attorneys with complex cases.
Work under supervision.
Conduct plea bargaining when appropriate with District Attorneys and others to resolve cases.
Attend seminars and review professional literature to maintain and develop skills.
Drafts/reviews, proposes and prepares reports and legal documents.
Public Defender 3 (PD3)
Represent clients in misdemeanors or juvenile cases and low to medium level felonies with limited supervision.
Provide guidance to lower level attorneys and law clerks.
Work under direction of higher level Attorneys and/or Managing Attorney.
Conduct plea bargaining as appropriate and continue professional development.
Drafts/reviews, proposes and prepares reports and legal documents.
Public Defender 4 (PD4)
Handle felony cases with limited supervision; may handle more complex felonies with guidance.
Handle appellate caseload and prepare appellate briefs; argue before Court of Appeals and Supreme Court with direction.
Provide guidance to lower level attorneys and work independently to resolve complex issues.
Attend seminars and maintain professional development; draft legal documents; perform related duties.

Minimum Qualifications PD2:
Current license as an attorney issued by the New Mexico Supreme Court or eligible for limited license issued by New Mexico Supreme Court.
PD3:
Current licensure as an attorney issued by the New Mexico Supreme Court or eligible for limited license issued by New Mexico Supreme Court and one (1) year of experience as a practicing attorney.
PD4:
Current license as an attorney issued by the New Mexico Supreme Court or eligible for limited license issued by New Mexico Supreme Court and four (4) years of experience as a practicing attorney.
Employment Requirements Must possess and maintain a valid driver's license. This position is covered by a collective bargaining agreement. Default FLSA: Exempt.
