DC Department of Human Resources . Located in the nation’s capital, The Office of the Attorney General (OAG) is the chief legal office of the District of Columbia. The OAG enforces the laws of the District, defends, and provides legal advice to the District’s government agencies and protects the interests of the District’s residents. This position is located in the Public Safety Division within the Domestic Violence & Special Victims Section. The Public Safety Division handles all cases where young people commit a law violation in the District of Columbia and prosecutes selected adult misdemeanor cases. The Domestic Violence and Special Victims Section and the Mental Health Sections protect victims of domestic violence, incapacitated adults who are being abused, and mentally ill adults who need emergency psychiatric care. The Restorative Justice Section facilitates conferences between the young people who commit crime and the victim, where the victim is interested. The Public Corruption Section prosecutes offenses related to fraud that undermine the public trust. Duties and Responsibilities
The Domestic Violence & Special Victims Section is seeking a Trial Attorney for its civil protection order practice. The attorney’s primary responsibility will be prosecuting criminal contempt actions for violations of civil protection orders. The attorney will: Investigate reports of violations; make charging decisions; fulfill discovery obligations; resolve cases through declination, diversion, plea agreement or trial; and monitor compliance with post-conviction conditions. Represent survivors obtaining civil protection orders in all aspects of civil litigation involving the order. Handle caseloads including intimate partner, dating violence, family violence, stalking, and sexual assault cases. Work closely with colleagues from public and private agencies to seek a broad range of remedies for survivors. Trial Attorney, LA-0905-12 Review information presented and relevant case law to determine whether a proceeding or filing should be initiated. Prepare complaints, motions, legal briefs/memoranda as appropriate. Prepare and conduct litigation including witness and exhibit preparation, evidence organization, preliminary proceedings, expert services coordination, witness examination, and oral arguments. Negotiate resolution of cases and determine when continued proceedings are not in the District’s best interest, with supervisor approval; prepare necessary court papers to implement negotiations. Perform case and calendar management duties and maintain case files and filings; ensure timely subpoenas and related administrative functions. Stay informed of legal and regulatory changes related to program functions and recommend actions. (additional duties for Grade 13): Extensive legal research; prepare memoranda supporting case conclusions; inform supervisor of facts and resolutions. Represent OAG in complex hearings; prepare and submit evidence, briefs, motions, and related documents. Stay current with laws and regulations; recommend action to leadership. Grade 12 qualifications:
Minimum of two (2) years’ legal experience in the areas above and at least one (1) year of specialized experience equivalent to LA-11 level, or its non-District equivalent. Grade 13 qualifications:
Minimum of four (4) years’ legal experience in the areas above and at least one (1) year of specialized experience equivalent to LA-12 level. For both grades, a demonstrated commitment to working with victims of domestic violence; at least one year of trial experience (preferably in criminal law); and ability to work independently. License and Certification The incumbent must be an active member in good standing of the District of Columbia Bar or gain admission within 360 days of appointment. Other Significant Factors
