General description: Applicants should be prepared to pass an extensive background investigation, including criminal history, employment, education, financial status, reputation, and social media checks. The OAG Foster Medicaid Fraud Control Unit works cases jointly with the FBI, HHS-OIG, and other federal law enforcement agencies. Applicants will also be required to obtain a Top Secret federal security clearance in order to participate as a Special United States Attorney (SAUSA). Full criminal and credit checks will be run on all applicants prior to employment. This posting is for an Assistant Attorney General in the Texas Medicaid Fraud Control Unit, cross-designated as a SAUSA, serving as a Trial Attorney/Prosecutor for the National Rapid Response Strike Force in the Health Care Fraud Unit of the U.S. Department of Justice, Criminal Division, Fraud Section. The Strike Force focuses on major health care fraud cases across multiple jurisdictions and coordinates with federal and state partners to identify, investigate, and prosecute significant multi-jurisdictional cases. Location: Houston, Texas (with the prosecution region encompassing the State of Texas). A three-year commitment to the Strike Force is required after accepting an offer. Responsibilities
Handle the development and management of health care fraud prosecutions, including all phases of investigation and litigation, grand jury engagement, advising federal law enforcement agents, preparing pleadings, litigating motions, conducting trials in U.S. District Court. Make charging decisions and propose dispositions for assigned cases. Collaborate with Unit managers to develop and maintain the Section’s program for national investigation and prosecution of health care fraud, including strategy development, policy, and legislative recommendations. The position is supervised by the Deputy Chief over Prosecutions in the OAG MFCU Austin headquarters, with day-to-day supervision by the Department of Justice. Training opportunities include Medicaid fraud training and national training with the National Association of Medicaid Fraud Control Units, subject to resource availability. As a grant-funded position, activities must align with a Texas Medicaid nexus. Essential Position Functions Prepare and present complex criminal cases involving federal health care laws and regulations Prepare legal opinions, briefs, pleadings, motions, petitions, and other legal documents Handle all phases of criminal prosecution from investigation through trial and appellate processes when necessary Analyze factual and legal issues, develop evidence through interviews, subpoenas, warrants, and other processes Perform legal research and report findings Advise investigators and management on factual and legal issues Assist investigators and auditors in investigations Travel as needed with reimbursement for business travel Maintain knowledge to perform essential job functions Attend work in accordance with policy and maintain security and confidentiality of information Comply with agency policies and federal grant requirements for MFCU Qualifications
MINIMUM QUALIFICATIONS
Assistant Attorney General (AAG) IV
Education: J.D. from an accredited law school Licensed to practice in Texas; in good standing with the State Bar of Texas Three years of full-time litigation experience Knowledge of relevant federal and state laws and procedures Strong multi-tasking, communication, and judgment skills Ability to conduct legal research, writing, investigations, proffers, plea negotiations, and trial preparation Ability to travel up to 50% and lift up to 30 lbs AAG V All above qualifications for AAG IV plus One additional year of full-time litigation experience Preferred Qualifications
Experience as a criminal prosecutor Experience with civil or criminal health care fraud matters Knowledge of white collar crime litigation Experience in supporting, litigating, and supervising federal or state criminal cases Experience in U.S. District Court and with the federal judiciary To Apply
