Overview

Senior Associate General Counsel / Staff Attorney 3 for Direct Care & Treatment (DCT), State of Minnesota. The role provides operational legal expertise, advice and related services to the DCT as the lead attorney supporting Mental Health and Substance Abuse Treatment Services (MHSATS), Community Based Services (CBS), Forensics Services (FS), and Ambulatory Care (AC) – including DCT Pharmacy and Medical Services. Work location: onsite at 100 Freeman Dr, St. Peter, Minnesota at least 50% of the time, with some telework opportunity. Telework available on a limited basis. Location eligibility for telework is restricted to Minnesota or neighboring states within 50 miles; more than 50 miles may allow higher telework in certain cases. Responsibilities

Provide legal advice and direction on issues including the Minnesota Commitment and Treatment Act; data privacy; protected health information; operations at DCT facilities; decisional capacity and due process relating to administration of neuroleptic medication and other treatment; criminal procedure; legal review of policies; management of litigation; consultation on and drafting of legislative proposals and Agency rule making; and matters related to facility and program licensing. Utilize labor-related information to provide legal counsel on employment and labor law matters including employment law, labor law, affirmative action/equal opportunity, employment investigations, discipline, arbitration, grievances, and collective bargaining processes for DCT. Minimum Qualifications

JD degree from an ABA-accredited law school; AND Current license in good standing to practice law in Minnesota; AND Four years of experience as a practicing attorney in civil commitment, healthcare, privacy, criminal law, state administrative law or a related field (up to one year as a judicial clerk). Experience must demonstrate: Provision of legal advice interpreting rules, laws, court orders and other legal/regulatory materials; Knowledge of the legislative process and federal and state laws; Strong legal research and analysis; Experience providing legal advice to senior management or executives as well as front-line staff. Preferred Qualifications

Five years of experience as a practicing attorney in civil commitment, healthcare, privacy, criminal law, state administrative law or a related field; Knowledge of state and federal laws relating to the Minnesota Commitment and Treatment Act, healthcare regulatory law, the Minnesota Health Records Act, litigation, mandated reporting statutes, guardianship statutes, employment and labor law, HIPAA, competency proceedings, and data practices acts; Experience identifying statutes and rules applicable to situations and advising decision-makers of legal consequences for compliance or non-compliance; Experience assessing impacts of proposed or adopted changes in law/regulation on DCT services, clients and staff. Additional Requirements
