Overview
Serves as the primary legal advisor to the EAA Board of Directors and EAA Executive Management. Responsibilities
Advise and act as agency resource on legal matters including administrative issues, transactional contracts, public finance, regulatory compliance, real estate, open records and open meetings, employment law, and EAA policies and procedures. Provide legal advice, counsel and assistance to the EAA and its Board of Directors. Analyze complex factual and legal issues and prepare briefs and general counsel opinions. Represent the EAA in litigation matters or administrative procedures and hearings. Draft, review, and revise agreements, contracts, and other legal documents related to the EAA operations, ensuring compliance with applicable laws, policies, and procedures. Stay abreast of statutes, court opinions, regulations, and other laws affecting EAA operations and administration. Manage, facilitate, and direct the work of outside counsel under direction of the EAA Board of Directors, the General Manager, or the authorized designee. Interpret federal and state laws as they apply to the EAA, including responsibilities and limitations as a political subdivision of Texas and a regulatory groundwater management agency. Research, analyze, and prepare legal memoranda, opinions, and training materials on local, state, and federal laws and updates. Manage the public election process for the EAA Board of Directors. Prepare and present periodic information for executive staff and board/committee meetings; participate in negotiations and mediations with state and federal officials, private entities, and customer representatives. Compile data and statistics related to legal work for reports; collaborate with others; maintain good standing with the State Bar of Texas and complete continuing legal education requirements. Work under long-range administrative direction and manage the work of direct reports; establish direction and strategic initiatives for major function. Qualifications
Juris Doctorate from an accredited law school; license to practice law in the State of Texas; in good standing with the Texas State Bar. Minimum of eight years’ experience as a licensed, practicing attorney with knowledge of federal, state, and local laws as they pertain to EAA operations and local governmental entities. Experience in environmental and administrative law, public law and public finance issues, complex real estate and business transactions, water law, contract law, labor and employment matters or related fields. Preferred areas: Texas surface water and groundwater rights; Texas Administrative Procedure; Texas Public Information Act; Texas Open Meetings Act; Texas Election Law; procurement for Texas Local Governmental entities. Experience working with an elected board of directors is a plus. Strong interpersonal, problem-solving, oral and written communication, and analytical skills. Valid driver’s license and ability to operate a motor vehicle. Physical and Work Environment
