The primary duty of the position is to Represent the State of Florida in all federal habeas cases in federal court. Qualifications

Admission to the Florida Bar and two years of professional experience in the practice of law, legal research, teaching law or in administrative or judicial hearings. The required legal experience must be from the practice of law in a state or territory of the United States. Membership in good standing in another state Bar can substitute for the required admission to the Florida Bar provided that, pursuant to Rule 11-1.10 of the Rules Regulating the Florida Bar, the attorney applies for and obtains admission to the Florida Bar within 12 months of appointment to a position in this class. Preference

may be given to applicants with postconviction and/or habeas experience. The Work You Will Do

This position’s duties include but are not limited to the following: Prerequisite to employment: Bachelor of Laws or Juris Doctor from an accredited law school and membership in the Florida Bar. Appeals duties: supervision of timely filing of pleadings and records on appeal; review of assignments of error; research to prepare and file briefs for the State of Florida; oral argument and all responsibilities attending prosecution of a criminal appeal. Federal Habeas Corpus Proceedings: Represent appropriate state official in habeas corpus proceedings filed by state prisoners in the federal courts in the District Courts for Florida. Handle claims of prisoners asserting federal constitutional rights violations, including review of state proceedings, preparation of pleadings and responses, and preparation of exhibits; handle hearings and post-trial proceedings as needed. Handle appeals to the United States Court of Appeals for the Eleventh Circuit and to the United States Supreme Court. Extraordinary Writs: Handle extraordinary litigation in both state and federal courts; perform civil litigation, special projects, post-conviction litigation and opinions as assigned by the Bureau Chief.
