Assistant Attorney General, Correctional Litigation Unit (OAG00592)

– The Virginia Office of the Attorney General (OAG) is seeking an attorney to represent and advise the Virginia Department of Corrections, Department of Juvenile Justice, and Parole Board in the Correctional Litigation Section. The attorney will litigate cases in state and federal courts involving alleged violations of inmates’ constitutional rights (including freedom of speech, religious freedoms, excessive force, and due process) and claims under the Americans with Disabilities Act and the Virginia Tort Claims Act. This position may also offer opportunities for appellate work on cases appealed after trial court disposition. In addition to litigation, the role includes advising client agencies on emerging legal issues and handling ancillary matters such as subpoena duces tecum and Freedom of Information Act requests. Other duties, as necessary or appropriate, may be assigned. This is a public service opportunity within a dynamic team.

The position reports to the Section Chief and can be based in one of the following OAG offices: Richmond, Abingdon, Fairfax, or Virginia Beach. Some overnight travel is required.

Responsibilities

Litigate cases in state and federal court involving inmates’ constitutional rights and related claims (e.g., freedom of speech, religious freedoms, due process, excessive force). Address claims under the Americans with Disabilities Act and the Virginia Tort Claims Act. Engage in appellate work on cases appealed after trial-level disposition when opportunities arise. Advise client agencies on emerging legal issues and respond to ancillary matters (e.g., subpoenas, FOIA requests). Collaborate with a team and, as needed, supervise others. Work independently or as part of a team and adapt to changing priorities.

Minimum Qualifications

Admission to the Virginia State Bar. Exceptional written and verbal communication skills. Proficiency in time management and the ability to work under pressure with limited supervision. Willingness to assist and supervise others. Ability to think creatively and apply practical, common-sense reasoning. Flexibility to work independently and as part of a team.
