Overview

An employee in this class provides assistance to attorneys in researching questions of law, investigating facts and preparing various legal documents. Duties are performed under the supervision of an attorney. Responsibilities

Research legal issues and questions of law for reference and use in court by attorneys. Research case law and prepares memoranda. Review case files to ensure legal sufficiency, a sound factual basis for evidence, and the availability of evidence in pending civil or criminal matters. Prepare subpoenas for attorney review. Prepare drafts of discovery and other legal responses for attorneys to review. Draft routine motion papers in civil and/or criminal matters, and, after review by an attorney, file papers with the court. Speak with caseworkers from Department of Social Services and obtain paperwork related to the investigation. Enter notes into the department’s Court Alert case management system as to what transpired on court cases. May be asked to appear in court with an attorney. Create a court calendar for use by all members of the bureau. Minimum Qualifications

OPEN COMPETITIVE Either: Graduation from a college with federally-authorized accreditation or registration by NY State with a Bachelor’s Degree in Paralegal Studies; OR Graduation from a college with federally-authorized accreditation or registration by NY State with a Bachelor’s Degree, and successful completion of a Paralegal Assistant certificate program given by a college or business school with federally-authorized accreditation or registration by NY State. Or: Graduation from a college with federally-authorized accreditation or registration by NY State with an Associate’s Degree in Paralegal Studies and two years of clerical experience in a law office (at least one year drafting motions and doing preliminary legal research); OR Successful completion of a Paralegal Assistant certificate program given by a college or business school with federally-authorized accreditation or registration by NY State and three years of clerical experience in a law office (at least two years drafting motions and doing preliminary legal research). Provisional Appointment Note

This role is a provisional appointment. A provisional appointment is temporary and applies when no eligible list exists or when an eligible list has fewer than three candidates willing to accept the position. To become permanent, the employee must take the next examination and be among the top three passing candidates who indicate willingness to accept the position. Civil Service law does not compel selection of a provisional employee among the top three.
