To analyze and interpret state statutes and regulations and to determine procedures for resolving disciplinary actions pending before the occupational licensing boards within the Office of Professional Licensure and Certification (OPLC). Experience and qualifications
Education/Experience: Equivalent combination of 9 years of education and experience after high school. Education and experience must include 4 years in the active practice of law. License/Certification: Valid driver’s license and/or access to transportation for statewide travel. Juris Doctorate from an American Bar Association recognized law school. Active member of the New Hampshire Bar Association and in Good Standing. Trainee Option: Candidates with an equivalent combination of 8+ years of education and experience after high school and 3 years in the active practice of law may be considered for trainee status. Responsibilities
Render official opinions on statutes and agency rules regarding viability of potential disciplinary actions in occupational licensing cases before the Boards, Councils, and Commissions within OPLC. Make recommendations regarding prosecution or dismissal, as well as sanctions. Supervise the evaluation of initial complaints by legal staff concerning possible violations of occupational licensing laws, administrative rules, and regulations; determine jurisdiction of licensing boards. Conduct legal research on disciplinary and licensing matters; draft motions, memoranda, and pleadings; negotiate settlements to resolve pending disciplinary matters prior to and in lieu of hearing. Oversee investigations by legal staff of formal complaints filed with occupational licensing boards; interview complainants, respondents, and witnesses; review detailed reports and provide recommendations; conduct training to ensure compliance with federal and state law. Prepare cases for administrative law hearings; prosecute disciplinary cases through evidence and witness testimony; identify and prepare witnesses and exhibit lists. Monitor disciplinary trends and proposed legislation; advise on agency impact and legal action; participate in legislative recommendations as needed. Interpret state statutes and regulations; provide legal analysis and counsel on occupational licensing disciplinary matters; respond to inquiries from the public, legal professionals, advocacy groups, and state/federal officials.
