Overview

The Consumer Protection Division seeks a licensed attorney for a highly competitive position on its Special Enforcement Team and will be based in Austin, Dallas, or San Antonio. Work involves planning and coordinating investigations into high-profile matters, including issuing Civil Investigative Demands, taking pre-suit depositions of well-represented opponents, and navigating privilege and other defenses asserted as part of these investigations. This candidate will also be comfortable driving fast-paced investigations with news-worthy implications. The Consumer Protection Division of the Office of the Attorney General of Texas, an agency of the State of Texas, works to protect Texas consumers and the legitimate business community by investigating breaches of fiduciary duties, fraud and deceptive advertising, filing civil lawsuits to enforce state and federal consumer protection and charitable trust laws, and educating Texans on how to spot and avoid possible scams. The Division has regional offices in Austin, Dallas, El Paso, Houston, and San Antonio. We provide a highly collaborative work environment where lawyers help one another while managing their own dockets as first and second chair from the initial stages of a case through resolution. Responsibilities

Analyzes complex factual and legal issues and develops evidence through witness interviews, undercover operations, examinations under oath, depositions, requests to examine, civil investigative demands, and other discovery Represents the Office of the Attorney General and other state agencies before state and federal district and appellate courts in charitable trust and civil enforcement cases pursuant to the Texas Business Organizations Code, Texas Trust Code, the Deceptive Trade Practices Act and other privacy and technology related consumer protection laws Performs all phases of civil litigation of consumer protection cases including the drafting of legal documents including petitions, motions, pleadings, orders, briefs, discovery, and memoranda; prepares cases for trial Prepares legal opinions, memoranda, briefs, pleadings, motions, petitions, and other legal documents Participates in administrative hearings and evidentiary hearings and in the discovery process Performs legal research and investigations; reports findings and conclusions Advises management on factual and legal issues Assists in drafting bills and amendments for legislative consideration Provides technical guidance to less tenured staff and may help train others Maintains knowledge of legal principles and practices relevant to Consumer Protection Maintains a low to medium volume of litigation cases and investigations Maintains confidentiality of all case-related matters Communicates with representatives of state agencies and consumers Performs related work as assigned Maintains relevant knowledge necessary to perform essential job functions Attends work regularly in compliance with agreed-upon work schedule Ensures security and confidentiality of sensitive and/or protected information Complies with all agency policies and procedures, including those pertaining to ethics and integrity Maintains a medium to high volume of litigation cases and investigations Qualifications

MINIMUM QUALIFICATIONS Experience: Two years of full-time experience as a licensed attorney working in fields such as Texas Business Organizations Code, Texas Trust Code, consumer protection; commercial litigation Education: Juris Doctor degree from an accredited law school Licensed as an attorney by the State Bar of Texas; must be in good standing and eligible to practice law in Texas by start date Skills: Handling multiple tasks, prioritizing, meeting deadlines; legal research, writing, and analysis; conducting investigations; mediation and negotiations; logical reasoning; prioritizing workloads; computer proficiency Skills: Working under pressure and cooperatively with attorneys, supervisors, investigators, and support staff; effective oral and written communication; sound judgment and decision making Knowledge: Law and legal principles, practices, and proceedings; state and federal laws, regulations, and rules Ability: Prepare legal documents, conduct research, interpret and apply laws, summarize findings, prepare cases and present at trial, conduct hearings, communicate effectively Ability: Handle stressful situations; receive and respond to constructive feedback; work cooperatively in a professional office environment; provide excellent customer service Ability: In-person work at designated OAG location; travel as needed; arrange for personal transportation for business travel Ability: Work more than 40 hours as needed and in compliance with FLSA; lift up to 30 lbs; travel up to 20% including overnight PREFERRED QUALIFICATIONS Education: Focus on consumer protection and/or commercial litigation Experience: Using electronic document review platforms (e.g., Relativity) and programs such as Excel, Outlook, Adobe Acrobat, Word Experience: One year of full-time experience in corporation law, nonprofit law, charitable trusts, consumer protection, or related civil litigation Knowledge: Texas Business Organizations Code, Texas Trust Code, nonprofit law, Texas Deceptive Trade Practices Act and consumer protection statutes including privacy laws Skills: Legal research, writing, and analysis; document review platforms Abilities: Proven ability leading others; proven ability to work within a larger organization Other Language: Proficiency in reading, writing, and speaking Spanish Seniority level
