Job Description - Assistant District Attorney (250006Z7) District Court Assistant District Attorney An Assistant District Attorney assigned to the District Court Division works under the supervision of the Deputy First Assistant District Attorney, the Director of Training and the Deputy Director of Training. An Assistant District Attorney is an employee of the Commonwealth of Massachusetts and serves at the pleasure of the District Attorney. The District Court Assistant District Attorney represents the Commonwealth before the Judges and Clerks of the District and Juvenile Courts, the Superior Court as assigned, and the appellate courts as assigned. They present Youthful Offender and Adult cases to the Grand Jury, evaluate cases and evidentiary issues at the earliest pre-trial stage, review charges at arraignment and pretrial conferences, and ensure adherence to office policies and procedures and sentencing guidelines. They prepare motions and memoranda of law, thoroughly prepare assigned cases for trial and ensure witnesses are properly notified. They follow Massachusetts Rules of Professional Conduct and have knowledge of suppression matters, grand jury practice, jury selection, evidence, and trial strategy. They read and use the Massachusetts Prosecutor’s Guide and Model Jury Instructions for Use in the District Court and handle post-conviction motions, while coordinating with various divisions for appeals and media relations as appropriate. They may be required to travel to courthouses in Essex County and perform additional duties as assigned. Private practice of law directly or indirectly is prohibited, whether compensated or not. In addition, Assistant District Attorneys perform other duties at assignments by the District Attorney or designees and may be required to travel to any courthouse in Essex County. Responsibilities

Represent the Commonwealth before the Judges and Clerks of the District and Juvenile Courts; Represent the Commonwealth before the Judges and Clerks of the Superior Court and appellate courts as assigned; Present Youthful Offender and Adult cases before the Grand Jury as assigned; Evaluate cases, identify evidentiary issues, and take corrective action at the earliest pre-trial stage; Review the appropriateness of charges at arraignment and pretrial conferences and take corrective action where warranted; Adhere to office policies and procedures, and to policies regarding sentencing recommendations; Prepare Direct Indictment Memos and notify supervisory staff of high-profile, newsworthy cases and media inquiries; Consult with supervisory staff regarding charging concessions, nolle prosequi or partial nolle prosequi filings consistent with office policy; Research legal issues and prepare motions and memoranda of law as necessary; Prepare assigned cases for trial and ensure witnesses are notified in advance; Follow Massachusetts Rules of Professional Conduct and applicable law on suppression, grand jury practice, jury selection, evidence, opening statements and closing arguments; Read and utilize the Massachusetts Prosecutor’s Guide and Model Jury Instructions for Use in the District Court; Research and handle post-conviction motions including motions to revise, revoke, or for a new trial; Notify appeals division of cases with targeted motions or notices that may require appellate action; Attend trainings and handle other duties as assigned by the District Attorney or designee; Coordinate with the Director of Media Relations on high-profile cases and direct all media inquiries accordingly; The essential functions of the position require the ability to receive and distribute information in written, oral, and electronic form in English. Qualifications

EDUCATION AND EXPERIENCE: J.D. Degree from an accredited law school and a member in good standing of the Massachusetts Bar Location & Schedule
