Job Summary In-house position for an experienced attorney with a minimum of five to eight years? experience in handling risk management, medical malpractice and civil litigation matters. Reporting to the system Vice President overseeing claims for Baylor Scott & White Health (BSWH). The Director-Assistant General Counsel (Dir-AGC) will represent BSWH system in legal proceedings and administrative actions and/or supervise outside counsel in such proceedings. The position will be based in the Administrative Office Building in Dallas, TX.

The Dir-AGC is expected to provide a proactive and collaborative approach to the legal and risk management issues associated with a dynamic and growing healthcare system. The Dir-AGC will handle pre-litigation claim matters and other risk management issues. It is important for the Dir-AGC to be a credible and effective leader who exhibits high integrity, a willingness to listen respectably, and to work collaboratively in our culture.

Essential Functions of the Role

Directs the legal function for assigned area of responsibility for BSWH.

Recommends and implements strategic and operational plans and priorities for legal services aligned to BSWH overall business goals.

Directs legal services for corporate, operational, and health care matters. Writes, reviews, edits, and finalizes agreements, reports, viewpoints, correspondence, and other legal documents.

Partners with and advises senior leadership on legal, regulatory, and risk management matters. Applies understanding of daily operations of BSWH acute care hospitals, clinics, and affiliates.

Manages and conducts research into various legal and risk management issues. Stays updated on legislation, trends, issues, and best practices in assigned areas.

Prepares, reviews, and assists in negotiating complex contracts. Assesses liability and damages. Develops defense to resolve claims successfully.

Advises on law, regulations, and court viewpoints. Directs the preparation of legal interpretations outlining facts and conclusions.

Coordinates communication with other attorneys to provide legal advice on business matters as needed.

Identifies legal and business risks and offers effective solutions tailored to the situations.

Reviews policies and programs to assess legal risk, render a conclusion, and communicate impact to BSWH.

Key Success Factors

Minimum of 5-8-years? experience handling risk management, medical malpractice and civil litigation matters.

Exercises excellent independent judgment as legal counsel and advisor.

Capable of assessing liability, damages and developing defenses to allegations for successful resolution of claims; Responsible for researching, briefing, legal issues; appearing in administrative agency matters; consulting with clients and opposing counsel; coordinating case handling internally and with respective claims? staff; consults with clients and opposing counsel; negotiates settlements; and completes necessary system documentation in a timely, comprehensive and effective manner.

Demonstrated ability to effectively analyze and balance legal, ethical and practical issues with a propensity for developing practical but legally appropriate solutions to issues and challenges.

Composed, open to criticism without personalizing; receptive to ideas.

A skilled listener and communicator at multiple levels, both orally and written, with individuals and groups; Ability to handle strong personalities and diverse opinions with ease and professionalism.

Displays mastery of complex issues, strategic perspective and savvy with demonstrated understanding and problem-solving abilities.

Possesses strong writing, research, communication and leadership skills.

Exhibits strong organizational, prioritization, and delegation skills with minimal supervision.

Demonstrates the ability to work in a team environment; Encourages dialogue within legal/risk management team, BSWH staff, other attorneys and related parties. Provides strong attention to detail coupled with the ability to make decisions in a timely manner.

Strong work ethic, drive with initiative and the ability to manage multiple case assignments at once in a fast-paced, performance-driven culture.

Computer proficiency with Microsoft Office, Westlaw, and the Internet

Juris Doctor from an accredited law school

Licensed member in good standing of the State Bar of Texas

QUALIFICATIONS

EDUCATION - Doctorate

MAJOR - Juris Doctor (JD)

EXPERIENCE - 5 Years of Experience required. 8 years preferred.

CERTIFICATION/LICENSE/REGISTRATION - Licensed State Bar Of Texas (LSBT)
