Senior Counsel, Ethics & Employment at Affirm. This dual-hatted role focuses on managing Affirm’s internal ethics program (ethics investigations) and advising on US employment matters (unrelated to ethics). Reporting to the Associate General Counsel, Employment & Ethics, you will join a small team and have the opportunity to drive impact quickly in a fast-paced environment. Affirm is building honest financial products with a remote-first culture. What You’ll Do
Ethics: Manage vendor transition and Affirm’s whistleblower hotline; regularly prepare critical reports about hotline activity for different audiences Conduct ethics investigations in a fair, timely, and professional manner; prepare clear reports and deliver findings to internal stakeholders Oversee and manage Affirm’s Code of Ethics and Business Conduct; review, draft, and adopt policies; manage vendor translation as needed; collaborate with cross-functional teams on policy development (e.g., global expansion) Develop solutions and apply Affirm’s policies to respond to ethics inquiries (conflicts of interest, gifts and entertainment, and other employee/job candidate inquiries) Build and maintain a library of ethics materials Launch regular training and communications initiatives, including developing communications content Employment Legal: Provide pragmatic US employment law advice unrelated to ethics matters (e.g., reasonable accommodations, leaves of absence, performance, separations, payroll tax, employee benefits) Draft and/or review employment agreements, policies, and internal/external communications Distill complex legal issues into helpful frameworks for cross-functional partners Communicate clearly to influence stakeholders; negotiate and manage pre-litigation matters, administrative claims or audits, and outside counsel as needed Monitor legal developments and educate key partners and the Employment Legal team Engage on special projects, potentially outside main jurisdictions or subject matter expertise What We Look For
J.D. from an accredited US law school; licensed in good standing to practice in a US state where Affirm has a presence (e.g., CA, NY, WA, TX) Minimum of 3 years of relevant investigations and legal experience at a leading law firm, or in-house plus firm experience Solid knowledge of key US employment laws (Title VII, ADEA, FCRA (employment context), FMLA, ADA, FLSA, EPA, NLRA, and state equivalents) High integrity and personal ethics; proactive, responsive, adaptable, and team-oriented Ability to develop solutions to complex legal matters while keeping business objectives in mind Strong organizational skills and ability to multi-task between Ethics and Employment Legal Excellent communication and attention to detail; intellectual curiosity and willingness to explore new technologies for scalable solutions Plus: Association of Workplace Investigations Certificate Holder CH-AWI Compensation and Perks
Pay Grade - O; Equity Grade - 8. Base pay ranges: USA base pay range (CA, WA, NY, NJ, CT): $215,000 - $265,000 per year USA base pay range (all other U.S. states): $191,000 - $241,000 per year Notes: Visa sponsorship is not available. Affirm is remote-first; most roles are remote, with some flexibility for office presence.
