At a proficient and independently-operating level with minimal supervision, advises and represents the Mesa County Sheriff’s Office, Mesa County and its departments in all aspects of county legal services to include Personnel and Employment Law, Property Taxation, Public Trustee Foreclosure matters, Contract Review, Real Estate, Land Use, Code Enforcement, General Civil Litigation, General County Government Law, subpoenas and records requests to include CORA and CCJRA Requests, and other matters as assigned by the County Attorney or First Assistant County Attorney.

Key Responsibilities

Provide legal representation for the County in all legal proceedings to which the County is a party, including court appearance and drafting of pleadings.

Handle subpoenas and responses to discovery requests and open records requests made pursuant to the Colorado Open Records Act (CORA) or the Colorado Criminal Justice Records Act (CCJRA).

Provide legal advice to selected County departments and elected officials as required; appear in Court as required.

Advise departments on questions of law pertaining to County business as assigned.

Research, prepare and draft ordinances, resolutions, legislation, contracts and other legal documents as required.

Advise Board of Commissioners appointed boards as directed.

Research, analyze and apply law to practical situations to proactively represent and, if necessary, defend county departments and officials.

Prepare and draft written opinions as may be required.

Communicate effectively orally and in writing with County officials and employees, court clerks and judges, opposing counsel and other professionals.

Maintain professional competence and training by attending related ongoing continuing legal education trainings.

Perform other duties as assigned.

Sheriff’s Office Responsibilities

Defend all litigation and provide legal training and advice to M.C.S.O. employees in all divisions.

Review current and prospective contracts, draft legal documents to include Memos of Understanding (MOU’s), Mutual-Aid agreements, Emergency plans, etc., as needed.

Draft Request for Proposals (RFP’s) and work with Division Commanders through the selection process.

Draft, consult, update and create new policies as needed.

Review, consult, and advise Sheriff on legislation effecting law enforcement, incarceration of individuals, and the criminal justice system.

Attend meetings as required by the Sheriff that may include State Capital legislation meetings and/or presentations affecting law enforcement.

Be available for after-hour phone calls.

Attend and participate in Court appearances as needed for representation of the Sheriff and/or employees in hearings.

Advise as requested on employee discipline.

Accept service of legal documents which initiate civil litigation against the agency or a member of the agency.

Advise on personnel issues to include hiring and termination.

Advise on Civil Processes to include evictions, emergency custody orders, Writ of Replevins, and Sheriff Sales.

Conduct civil forfeiture process.

Advise on Extreme Risk Protection Orders (ERPO).

Perform other duties as assigned.

Minimum Qualifications

Juris Doctorate and 5 years of progressively responsible related legal experience, including 2 years of litigation experience, or similarly related experience.

Current license to practice law in the State of Colorado.

Any combination of education, training and experience which provides the knowledge, skills and abilities required for the job. The ideal candidate will have the ability to work successfully with law enforcement personnel.

Physical Requirements This position requires standing, stooping, sitting, bending, twisting, and lifting up to 25 pounds.
