We are seeking a motivated, detail-oriented and enthusiastic early-career IP Counsel to join the team. In this role, you will be responsible for a diverse range of IP matters, including assisting in the development of the company’s patents, trademarks, copyrights, and trade secrets, and for the strategic protection, expansion and enforcement of its mission-critical intellectual property portfolio. You will have a strong interest in software technology and IP law and the ability to proactively issue-spot in ambiguous situations. Responsibilities
Assist company efforts to maintain and expand its patent and trademark portfolio, be a valued member of the Patent Review Committee (PRC), collaborating with CTO, R&D, and product teams to identify and protect innovation.
Manage IP budget and outside counsel relationships, including partnering with outside counsel to draft, review, and prosecute patent and trademark applications.
Protect company intellectual property, including by assisting Chief Litigation Counsel in litigation related to company intellectual property enforcement actions, and by supporting and collaborating with privacy and product security teams to respond to cyber threats and/or data breaches.
Review and draft IP-related clauses in commercial agreements, NDAs, licensing agreements, and vendor contracts. Prepare intercompany agreements and licenses for affiliate use of intellectual property. Support the use of open-source software in the company’s proprietary software code. Conduct IP due diligence for mergers, acquisitions, and strategic partnerships.
Monitor, report, and provide training on IP developments, including litigation, enforcement actions, and regulatory developments. Maintain corporate policies regarding copyrights, confidential information, AI use, open-source software use, and IP records and databases.
Qualifications
You hold Juris Doctor (JD) degree from an accredited law school, with admission to practice law in at least one U.S. jurisdiction and in the U.S. Patent and Trademark Office.
You have 2-4 years of experience in IP law, preferably in a law firm or corporate legal department.
You have knowledge of patent and trademark prosecution processes. Prior patent prosecution experience is a plus.
Strong analytical, organizational, and communication skills.
Ability to work collaboratively across global teams and to manage multiple priorities in a fast-paced environment.
An understanding of open-source licensing and software IP issues is preferred.
Compensation & Benefits The annual base salary range represents the low and high end of the BMC salary range for this position. Actual salaries depend on a wide range of factors that are considered in making compensation decisions, including skill sets, experience and training, licensure, and certifications, and other business and organizational needs. The listed range is one component of BMC's employee compensation package; other rewards may include a variable plan and country-specific benefits. A reasonable estimate of the current range is $129,375 - $215,625, with midpoint around $172,500.
