Deputy District Attorney III/IV (SIGN-ON BONUS) County of Monterey – Sign‑on bonus of up to $10,000 available to candidates hired into this classification after July 01, 2024.

We are seeking Deputy District Attorneys for both the Criminal and Civil Divisions.

The position involves managing a high volume of complex and difficult cases, performing extensive legal research, and presenting matters before the court.

Responsibilities

Prepares and prosecutes cases by presenting opening statements, interrogating and cross‑examining witnesses, introducing evidence, making relevant objections, arguing points of law, and presenting closing arguments.

Researches questions of law and evidence and applies statutory and decisional case law, along with other legal treatises, in the preparation of cases for hearing in court.

Attends scheduled court hearings such as arraignments, pre‑trial hearings and motions, sentencing and probation revocations, and forfeiture proceedings.

Prepares legal briefs, motions, memoranda of points and authorities, documents and pleadings.

Interviews victims, police officers and witnesses.

Determines the nature of follow‑up investigations needed for trial or settlement.

Marshals, reviews and prepares evidence for presentation in court, mediation or other resolution proceedings.

Negotiates the appropriate disposition of cases without going to trial.

Evaluates requests for the issuance of criminal or civil complaints; analyzes evidence presented for sufficiency and determines if additional evidence is required.

Advises the general public and law enforcement personnel on criminal and other matters affecting the health and safety of consumers.

May be assigned to train and/or serve as lead worker over less experienced attorneys.

Qualifications

Current, valid membership in the California State Bar required by date of hire.

Working knowledge of the duties, responsibilities, powers and limitations of the Office of the District Attorney.

Knowledge of ethical standards that apply to prosecutors and attorneys.

Proficient in legal research and writing; familiar with the rules of evidence.

Thorough knowledge of the principles of criminal and civil law, criminal procedure, and trial practice.

Statutory, constitutional and decisional criminal laws of California.

Ability to use a computer and evaluate complex data to formulate effective action.

Excellent written and oral communication skills; able to present persuasive arguments in court and to diverse audiences.

Strong judgment and independent problem‑solving abilities; able to manage a heavy caseload under general supervision.

Experience in negotiation, mediation, or settlement processes is an asset.

Experience in a District Attorney’s Office, Attorney General’s Office, Public Defender’s Office, or a private criminal defense firm is preferred.
