Overview Performs moderately complex to highly complex legal work in the prosecution of enforcement cases at the State Office of Administrative Hearings (SOAH) and at Informal Settlement Conferences (ISC). Develops prosecution strategy for complex cases, negotiates agreed settlement orders, files discovery, takes and defends depositions in contested case hearings, drafts briefs and closing arguments. Substantially covers medical care issues related to the practice of medicine, professional boundaries, and medical ethics and works closely with expert witnesses in medicine and ethical professionalism.

Principal Job Duties and Responsibilities

60% Prosecutes enforcement cases at ISC involving licensees of the agency, preparing packets, presenting at hearings, developing agreed orders, coordinating with support staff, and drafting negotiated orders.

30% Prosecutes contested cases at SOAH involving licensees, drafting pleadings, filing complaints/petitions, pre‑trial motions, case briefs, closing arguments, representing the agency in all phases, conducting discovery and depositions, performing legal research, developing settlement options, representing the board at mediation, and finalizing Agreed Orders.

5% Represents the agency as prosecutor at Temporary Suspensions/Restriction Hearings and prepares Order of Temporary Suspension/Restriction.

5% Attends court hearings and Board meetings as requested and performs other legal duties as assigned.

Required Experience and Education

Licensed and in good standing to practice law in Texas for a minimum of three years.

Graduated from an accredited law school with an L.L.B. or J.D. degree.

Litigation experience in administrative, regulatory, or health law, or prosecutorial experience.

Litigation experience as lead attorney in cases prosecuted at the SOAH preferred.

Must be proficient in Microsoft Suite (Word, Excel, Outlook), SharePoint and Teams.

Knowledge, Skills, and Abilities

Knowledge of legal principles and practices related to administrative law and licensing of professionals, especially healthcare licensees.

Knowledge of applicable laws and rules regarding licenses of the agency.

Knowledge of the Administrative Practices Act and Texas Rules of Civil Procedure.

Ability to interpret and apply laws.

Knowledge of medical terms and definitions.

Ability to conduct hearings, research, and prepare cases.

Effective oral and written communication skills.

Ability to manage multiple duties, meet deadlines, and work effectively in a team environment.

Work Environment Requirements

Standard in‑office or remote setting; may require travel to Austin, TX for meetings.

Regular and punctual attendance Monday–Friday.

Responsive communication: within 72 hrs for external, within 24 hrs for internal, and within 15 minutes while working remotely.

Frequent use of personal computers, copiers, printers, phones, and sitting for extended periods.

Compliance with all agency policies and procedures, including confidentiality, security and safety rules.

Physical Requirements and Working Conditions

Reliable high‑speed internet access (≥20 MBPS download, 2 MBPS upload); confirmation may be required.

Frequent use of keyboard, mouse, microphones for video calls, phone calls, virtual meetings.

Occasional lifting of equipment up to 10–40 lbs.

Low physical demands; mainly sitting, typing, and meetings.

Legal Requirements

Telework authorization cannot be a condition of hiring; probationary training required before telework agreement.

TXDPS criminal history check required for all new hires.

No outside employment conflicts or dual agency employment allowed.

Must reside in Texas and provide identification within three days of hire.

New Hires/Rehires 60‑day waiting period for health coverage.
