Job Title : Litigation Paralegal - Personal Injury (In Person/Remote)
Location : California (Applicants must reside in California)
Responsibilities
Assist Attorney in the preparation of legal documents including government claims, complaints, motions, declarations, petitions, briefs, demands, case management statements, and other similar documents.
Assist Attorney to prepare, propound, and respond to written discovery, defense medical exams demands, inspection demands, depositions, civil subpoenas, and related documents prior to the discovery cutoff deadline.
Assist Attorney in preparing documents related to designation and retention of expert witnesses, managing expert files, and coordinating expert depositions before the expert discovery cutoff.
Assist Attorney to prepare trial-related documents (e.g., statement of the case, witness statements, exhibit lists, binders, motions in limine) and coordinate trial testimony.
Assist Attorney to calendar and manage all statute of limitations related to the client’s case.
Research and analyze statutes, regulations, legal articles, and judicial decisions; provide written analysis to attorneys.
Communicate with clients every 30 days regarding injuries, medical diagnoses, treatment status, and case updates.
Obtain, update, and finalize subrogation liens (e.g., third-party health insurance liens, Medi-Cal, Medicare).
Locate medical experts and authorize medical treatment as needed; document medical specials and perform Howell analysis.
Request and manage medical records, bills, and loss of earnings documents in a timely manner.
Open and manage insurance claims and confirm insurance coverage.
Draft medical summaries and draft settlement demands for attorney review.
Process settlement documents, including release and settlement checks, and manage disbursement.
Maintain full compliance with HIPAA and confidential records; complete training as assigned by the Director of Litigation Division – Operations.
Perform other paralegal and case management duties as assigned by the handling attorney.
Must be familiar with the California Code of Civil Procedure and able to calculate legal deadlines for all documents served via various service methods.
Draft and execute valid proofs of service and file documents with the Superior Court of California.
Familiarity with the Federal Rules of Civil Procedure and ability to file documents with PACER preferred.
Familiarity with Medicare Set Aside, settlement planning, and related legal processes.
Compliance with Business and Professions Code section 6450, including mandatory continuing legal education in ethics and relevant law.
Education and Experience
Bachelor’s degree in business administration, criminal justice, or related field preferred.
5+ years in a litigation paralegal role in civil litigation, preferably personal injury.
Eligibility and compliance with Business and Professions Code section 6450 (c) demonstrated by one of the following:
ABA-approved paralegal program certificate; or
Paralegal program certificate/degree with required law-related coursework and state Bar supervision; or
Baccalaureate or advanced degree with relevant law experience under attorney supervision and a statement from the supervising attorney confirming qualifications; or
High school diploma with three years of law-related experience under attorney supervision and a statement from the supervising attorney confirming qualifications.
