Primary Purpose Serve as a senior member of the District’s leadership team and provide in-house legal counsel, representation, and assistance to the Superintendent, campus and department administrators, and the Board of Trustees, regarding all areas of school operations.
Qualifications Education/Certification
Doctor of Jurisprudence (J.D.) degree from a nationally accredited law school and valid license to practice law in the State of Texas
Experience
Five years’ experience in public or private practice dealing with legal issues of local, state, federal government, or public school law
Special Knowledge/Skills
Thorough knowledge and understanding of local, state, and federal laws and regulations relating to public education
Demonstrated abilities in legal research and writing, as well as interpretation of law, policy, and procedures
Exceptional analytical, organizational, communication, public relations, and interpersonal skills
Ability to maintain emotional control under stress
Ability to balance and prioritize multiple, simultaneous demands and meet deadlines with strict time constraints
Strong interpersonal skills, including but not limited to, the ability to understand human motivation and the ability to apply such knowledge to maintain good working relationships with district representatives, co-workers, subordinates, and others
Preferences
Experience in public school law
Thorough knowledge and understanding of local, state, and federal laws, and regulations relating to public education, including but not limited to civil litigation, the legislative process, employee and labor relations, local governance, special education, administrative complaint processes, school operations, business and contracts, school district police departments, and elections
Major Responsibilities and Duties
Adhere to local, state, and federal laws, rules, and regulations, as well as District policies, procedures, and regulations
Maintain a positive and effective working relationship with the Superintendent, Board, and District administrators
Supervise the legal department, including the evaluation of department staff, and manage the legal department budget
Oversee and manage litigation and representation of the District in administrative and judicial proceedings
Make legal assignments and coordinate legal services to the District by outside law firms and professional services, and ensure legal services provided support the goals and objectives of the District
Advise the Superintendent, staff, and Board on legal issues related to school operations
Draft, review, and revise legal documents, including District handbooks and procedure manuals
Attend Board meetings and other administrative meetings to provide legal counsel and monitor compliance with the Texas Open Meetings Act
Provide legal assistance on District elections
Draft and/or coordinate necessary responses to state and federal investigations (such as EEOC charges, TEA complaints, and OCR complaints)
Draft, review, revise, and negotiate, as necessary, District contracts, including employment contracts, construction, real estate, and other vendor contracts
Coordinate and advise staff on conduct of complaint processes, including local grievance process
Monitor and interpret the impact of proposed or enacted legislation and provide legal assistance in the drafting of proposed legislation
Remain current on legislation, laws, commissioner decisions, attorney general opinions, and other legal decisions affecting public entities in Texas
Prepare materials and conduct professional development and training for District stakeholders on various legal topics
Coordinate and respond to external requests and/or subpoenas for employee and/or student records
Review and revise District policy and procedures, as necessary, and coordinate policy updates received from TASB and initiated internally
Review and oversee District’s compliance with the Texas Public Information Act, drafting requests for attorney general opinions when necessary
Review and revise Board meeting agendas for compliance with Texas Open Meetings Act
Provide advice and assistance to the Human Resources Department and District management regarding appropriate handling of complex employee and applicant issues, including but not limited to investigation and responding to EEOC charges and representing the administration in responding to grievances and appeals thereof
Coordinate investigations related to allegations of employee misconduct, and as necessary, recommend corrective action to be taken
Review and interpret child custody documents and provide campus and District administrators with targeted guidance
Attend conferences and meetings with District personnel, parents, and students, as the District’s legal representative when opposing counsel will be present, including but not limited to ARD meetings, DAEP placement conferences and appeals, and grievance hearings
Interface with governmental agencies, business and civic organizations, and the community to provide needed information and to promote the District’s educational initiatives
Effectively communicate with all District stakeholders
Participate in professional development necessary to maintain license to practice law in the State of Texas and/or as otherwise required by the District
Render legal advice to the Superintendent and perform other duties as directed by the Superintendent
Working Conditions Mental Demands
Ability to communicate effectively (written and verbal), analyze complex legal issues, manage multiple competing priorities simultaneously, maintain emotional control under stress, interpret policy, procedures, and data, coordinate district functions, work with frequent interruptions
Physical Demands/Environmental Factors
Attendance and presence at the work site, frequent prolonged and irregular hours, repetitive hand motions, prolonged use of computer, steady phone interactions, moderate standing, walking, and bending, occasional district-wide travel
