Handle mortgage-related litigation files as lead counsel in State, Federal and Bankruptcy Courts. Draft and file documents such as proofs of claim, objections to confirmation, and motions for relief from the automatic stay. Communicate daily with clients, debtors, and attorneys. Hearing attendance may be required. This position is in‑office. Essential Functions
Provide legal advice to the Firm’s mortgage servicing clients. Communicate with clients through phone, email, and client database systems. Research and analyze legal sources such as statutes, recorded judicial decisions, legal articles, treaties, constitutions, and legal codes. Prepare legal briefs, pleadings, appeals, contracts, and any other necessary legal documentation for litigation in State Circuit Court, Probate Court, Appellate Courts, Federal District Court, and Federal Bankruptcy Court. Handle civil litigation cases from referral to resolution, utilizing written and oral advocacy, motion practice, discovery, trial preparation, trial, and appellate court briefing and argument. Participate in mediation and demonstrate understanding of complex loan documentation and loss mitigation processes. Review staff work product for accuracy. Maintain current knowledge of trends, regulations, or legislation affecting the assigned area of practice. Settle cases and attend hearings. Perform additional duties as requested. Position Preferences
Juris Doctorate required. Licensed to practice law in the State and Federal Courts in TX, including Bankruptcy Court and the Eighth or Fifth Circuit Court of Appeals. 2+ years’ litigation‑specific experience. Experience preferred in finance or representation of financial institutions in real‑estate related matters. Exceptional communication skills (oral and written). Ability to work through complex mortgage‑related issues. Must be PC literate and able to rapidly adapt to a variety of database systems. Ability to represent the company in various forums to foster the desires and image of the company in the community. Characteristics
