Join the New York State Education Department’s Office of Professions (OP) in the Office of Prosecutions (OPD) as a Senior Attorney. Under the direction of OPD management and a Supervising Attorney, you will support investigations and litigation related to professional misconduct and licensing matters.
Responsibilities
Participate in the development and review of investigations into allegations of professional misconduct.
Provide legal advice to OPD investigators and to members of the state boards of the professions.
Engage in settlement negotiations in professional misconduct cases.
Prepare for hearings, and try before panels of the various state boards, including moral character cases and restoration of license cases.
Represent OPD before the Regents Review Committee on reviews of hearing panel decisions.
Research and prepare briefs, memoranda of law, specifications, other legal pleadings, internal memoranda, and correspondence.
Effectively and timely manage the assigned caseload.
Interact professionally with the Board of Regents, state professional boards, NYSED staff, opposing counsel, witnesses, and members of the public.
Minimum Qualifications NY HELPS Non-Competitive Minimum Qualifications
Assistant Attorney 1: Law School graduation and/or eligibility for NYS Bar Admission.
If not admitted to the New York State Bar within two years of appointment, the appointment will be terminated.
Assistant Attorney 2: NYS Bar Admission.
Assistant Attorney 3: NYS Bar Admission and at least one year of satisfactory legal experience.
Senior Attorney: Juris Doctorate degree, NYS Bar Admission, and at least two years of satisfactory legal experience.
NY HELPS Competitive Minimum Qualifications
Reassignment: One year of permanent competitive or 55b/c service as a Senior Attorney.
Eligible List Appointment: Reachable on the Civil Service eligible list and complete any canvass letter required.
Section 70.1 Transfer: One year of permanent competitive or 55b/c service in a Senior Attorney Realty title.
Section 52.6 Transfer: One year of permanent competitive or 55b/c service in a title SG-25 or higher; applicants must hold a Juris Doctorate, be admitted to the Bar in NY or a state with reciprocity.
55b/c Appointment (Assistant Attorney 1): Current 55b/c eligibility letter and the qualifications for Assistant Attorney 1.
55b/c Appointment (Senior Attorney): Current 55b/c eligibility letter and the qualifications for Senior Attorney.
Additional Comments
This role will be a permanent, competitive or permanent non-competitive appointment.
Promotions and transfers may change the negotiating unit.
Verification of degree, bar admission and work experience is required at interview.
Continued employment as a Senior Attorney depends on maintaining admission to the NY State Bar.
Requires 10% in-state/out-of-state travel; up to 30% telecommuting per bi-weekly pay period if approved.
The position may be filled as a traineeship; successful completion of trainee program is required for full performance level.
Base pay range: $96,336 – $121,413 per year with a $4,000 Downstate Adjustment.
