Attorney II – NYC Department of Social Services
Overview The Commercial Law Unit of the Office of the Legal Affairs manages a large and increasing volume of sophisticated legal work, including counseling, the preparation of legal documents such as contracts and law opinions, and special projects in all areas of commercial, real‑estate acquisition and maintenance, construction, land use and environmental, financial (including insurance, securities and federal funding), and corporate law. The Unit also acts as liaison and agency representative in transactions between the Department and other city agencies.
Responsibilities
Provide legal assistance to DHS/HRA program areas by researching legal questions, interpreting agreements, laws, rules and regulations related to the delivery of services.
Draft, review and negotiate legal documents: contracts, leases, data‑use agreements, non‑disclosure agreements, license agreements, memoranda of understanding or appeals. Prepare legal memoranda and advisory opinions as requested.
Negotiate on behalf of the Agency to obtain contracts, settlements or judgments. May conduct legal discovery to obtain evidence and research sophisticated legal issues by reviewing statutes, case law, regulations and other legal material to formulate arguments and strategy.
Provide guidance to other attorney staff members and support staff, including staff training on policy, practices and new procedures. May review case files, recommend follow‑up action, and assume full responsibility in the absence of a supervisor.
Perform other related tasks.
Minimum Qualifications
Admission to the New York State Bar and either one year of satisfactory U.S. legal experience after admission to any state bar, or six months of satisfactory service as an Agency Attorney Intern (30086).
Incumbents must remain members of the New York State Bar in good standing for the duration of employment.
Assignment Level Requirements To be assigned to Assignment Level II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience after admission to the bar, in the areas of law related to the assignment. To be assigned to Assignment Level III, candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience after admission to the bar.

Ability to perform legal analysis.
One year’s relevant experience working with the New York City contracting process (preferred).
