Your Team The Office of Development leads affordable housing efforts through new construction and preservation. The Housing Incentives division offers tax credits, tax incentives, and zoning bonuses to facilitate affordable housing development. The Compliance and Enforcement (C&E) division investigates and takes enforcement action against building owners who fail to comply with applicable laws, codes, regulations, and agency agreements.

Your Impact As an attorney in the Compliance and Enforcement division, you will investigate and take enforcement action against building owners receiving benefits who fail to comply with state and local laws, codes, and regulations, ensuring more affordable and rent‑stabilized apartments for New Yorkers. You will supervise a team of paralegals and contribute to major compliance efforts focused on rent registration, affordability requirements, and regulatory agreements.

Your Role In your senior attorney role, you will assist the division in ensuring building compliance with valuable benefits under the direction of the Assistant Commissioner (AC) of Compliance & Enforcement. You will be the agency’s subject‑matter expert on compliance and enforcement of tax incentives, investigating and taking enforcement action against non‑compliant owners, drafting and reviewing legislation, and preparing agency reporting requirements.

Responsibilities

Receive and analyze complaints of non‑compliance from HPD programs and outside sources to determine sanctions, penalties, or revocation of benefits.

Investigate complaints by collecting facts from public sources, property owners, and residents.

Make legal recommendations on violation scope and appropriate remedies.

Prepare legal documents to prosecute violations or revoke benefits.

Resolve cases through negotiated settlement, administrative proceedings, or court appearances, including a small number of appearances before OATH.

Serve as the primary contact for owners, owners’ counsel, and residents of properties in assigned cases.

Report case status regularly to the Assistant Commissioner and senior staff.

Maintain and update case management systems with accurate tracking information.

Provide input on policy and procedural improvements to strengthen enforcement cases.

Supervise attorneys, paralegals, and/or assistant project managers.

Assist in producing an annual report listing buildings for which benefits were revoked.

Preferred Skills

A JD and at least one year of civil litigation or regulatory enforcement experience after New York bar admission.

Experience with tax or real estate matters.

Excellent verbal and written communication skills.

Strong interpersonal, creative problem‑solving, and organizational skills.

Superior analytical, research, and attention‑to‑detail skills.

Ability to work productively and collaboratively within a team.

Demonstrated independence and excellent judgment.

Ability to meet deadlines and manage cases and projects promptly.

Willingness to learn on‑the‑job and handle multiple priorities in a fast‑paced, detail‑oriented environment.

Strong proficiency with Microsoft Office Suite (Word, Excel, PowerPoint, Outlook).

Preference for candidates with experience in government agencies or programs related to affordable housing compliance.

Minimum Qualifications

Admission to the New York State Bar; and one of the following:

One year of satisfactory U.S. legal experience after admission to any state bar; or

Six months of satisfactory service as an Agency Attorney Intern (30086).

Incumbents must remain in good standing with the New York State Bar for the duration of employment.

Additional Information To be assigned to Assignment Level (AL) II, candidates must have one year of experience at AL I or two years of comparable legal experience at AL I/II. For AL III, candidates must have two years of experience at AL I/II or three years of comparable legal experience.
