Assistant Public Defender Minimum Qualifications

Juris Doctorate Degree required.

Supplemented by nine years of experience as a practicing criminal defense attorney, including lead or supervisory experience.

State Bar of Georgia licensure and certification.

Valid driver’s license.

Additional requirements for attorneys licensed in other states with reciprocity to Georgia: passed a bar exam in a reciprocal jurisdiction and met all other qualifications set by the State Bar of Georgia.

Specific License or Certification Required

Must possess and maintain certification and licensure from the State Bar of Georgia.

Must possess and maintain a valid driver’s license.

Attorneys licensed in other states that have reciprocity with Georgia seeking admission on motion without examination must have passed a bar exam in a reciprocal jurisdiction and meet other qualifications required by the State Bar of Georgia.

Specific Knowledge, Skills, or Abilities

Demonstrate proficiency in the performance of essential functions and ability to learn, comprehend, and apply all county or departmental policies, practices, and procedures necessary to function effectively.

Knowledge of federal, state, and local criminal laws; policies and procedures governing assigned courts; and methods and techniques related to the area of assignment.

Essential Functions

Lead and coordinate daily work activities of assigned employees, confer with supervisor for direction, and plan tasks to complete assigned work.

Represent clients in court at all stages—including arraignments, pretrial hearings, sentencing, post‑adjudication and appeals—by negotiating, preparing, and arguing motions; conducting jury selection; making opening and closing statements; presenting evidence; questioning witnesses; and making objections.

Investigate and prepare cases for hearings and trials by reviewing discovery, interviewing clients, requesting and inspecting records, exploring alternative explanations, identifying and interviewing witnesses, subpoenaing witnesses, preparing clients and expert witnesses, anticipating legal issues, and developing defense theory and strategy.

Represent clients at pre‑trial conferences to secure and argue mitigating evidence, negotiate resolutions with assistant district attorneys, and advise on plea offers.

Coordinate post‑adjudication, disposition, and conviction follow‑up and relief: secure mitigating evidence for sentencing or restitution, review court orders and case plans, file related motions and appeals, advocate for client, and secure additional services.

Conduct case research and documentation: research relevant case law, interpret it, prepare briefs and motions, write case summaries, draft jury charges, and make trial notes.

Communicate with, advise, and advocate for indigent clients, developing a trusting attorney‑client relationship and providing updates on case status.

Manage caseload: attend scheduled court appearances, create new case files, input and record case‑related data and notes, log case activities, close files, review calendars, and coordinate with court administration, clients, witnesses, experts, and others.

Maintain and upgrade knowledge in appropriate legal fields by attending conferences, seminars, meetings, and training events, staying abreast of legal changes, and participating in professional organizations.

Communicate with prosecuting attorneys, judges, investigators, legal support staff, witnesses, experts, translators, client friends, probation officers, supervisors, government officials, other employees, the public, and others as needed to coordinate work activities and resolve issues.

Process a variety of documentation associated with department operations, reviewing, completing, forwarding, and retaining forms, reports, letters, notices, petitions, briefs, and summaries.

Perform other related duties as required.

Functional Reasoning: Apply principles of logical or synthesis functions, analyze major problems requiring complex planning across work units.

Situational Reasoning: Exercise judgment, decisiveness, and creativity in complex, moderately unstable situations involving broader organizational programs.
