The Legal Counsel, IP & Marketing, will manage all aspects of Benefit’s intellectual property program and provide marketing content counsel to Benefit’s marketing teams. This role is a partner to the global markets to support with questions regarding intellectual property and provide guidance regarding all IP and marketing matters. This role also maintains, manages, and defends all Benefit Cosmetics LLC Intellectual Property, inclusive of trademarks, patents, and copyrights. What You’ll Do: Draft bi-annual IP, marketing, and anti-counterfeit memorandums, highlighting key wins and risks, trends in these areas, and recommendations for future actions Manage and maintain all aspects of Benefit’s global intellectual property program, including patents, trademarks, copyrights, and trade secrets Trademark clearance, prosecution, and general counseling related to the maintenance and enforcement of Benefit’s domestic and foreign trademark portfolios Instruct, supervise, and collaborate with outside counsel on trademark disputes, including administrative or trademark-office disputes Marketing Provide support to global marketing teams to ensure marketing content complies with applicable regulations Develop and provide intellectual property and marketing training to the global business teams (ex: how to use assets appropriately, how to appropriately use third-party assets) Work with global teams to substantiate and correctly leverage product claims, and provide claims placement recommendations for global project packaging, marketing campaigns, etc. Work in conjunction with other LVMH Legal Departments, and external counsels as needed Qualifications: J.D. degree and a member in good standing of the bar in at least one state(CA preferred) Global experience in IP required, Global marketing business partnership strongly preferred 5+ years of relevant experience in corporate practice (in-house experience strongly preferred) Experience with IP portfolio management and IP portfolio management software Experience with trademark clearance, prosecution, and enforcement Experience with anti-counterfeit programs and advising marketing teams on campaigns Proficient in MS Office programs Schedule: Hybrid - requires onsite presence weekly to a Benefit Office The target salary range for this position in California is $130,000 - $164,000 annually. The actual salary offered is based on market location and will depend on a variety of factors, which may include, as applicable, years of relevant experience; certifications or other professional licenses held; other legitimate, non-discriminatory business factors specific to the position; and the geographic location in which the applicant lives and/or from which they will perform the job. This position is eligible to earn an annual bonus.
