Legal Partner For Marketing And Brand Teams
We're seeking a qualified attorney to serve as a key legal partner to our Marketing and Brand teams. This role will be responsible for reviewing promotional materials, advising on compliance with U.S. advertising and gaming laws, and overseeing intellectual property matters. The ideal candidate is business-minded, collaborative, and experienced in navigating marketing and IP issues within regulated environments. Key responsibilities include: Marketing & Advertising Compliance: Review and approve promotional campaigns and terms, including acquisition and retention offers, odds boosts, loyalty programs, and materials connected to new product features. Ensure all marketing content complies with applicable federal and state laws, as well as advertising and gaming regulations (e.g., FTC, state gaming commission regulations, etc.). Collaborate with creative and compliance teams to ensure clarity, fairness, and accuracy in all promotional messaging. Marketing Asset Review: Provide legal sign-off on all marketing assets including digital ads, emails, social media posts, affiliate content, influencer campaigns, and media buys. Help craft compliant disclaimers and disclosures, ensuring alignment with regulatory standards and brand voice. Intellectual Property: Advise on brand usage, trademark protection, and content licensing across digital and traditional media. Review materials for and provide proactive IP guidance around use of third-party trademarks, as well as NIL. Support partnership agreements, sponsorship deals, and brand collaborations, ensuring proper use of IP and compliance with contractual obligations. Strategic Legal Support: Educate internal teams on legal risks and best practices in marketing and brand strategy. Monitor developments in advertising law, gambling regulations, and IP trends, and assess their impact on business operations. Support internal processes to ensure timely legal reviews without slowing down innovation. Qualifications: Juris Doctor (JD) from an accredited law school; licensed to practice law in New York or eligible for in-house counsel registration. 36 years of relevant experience at a law firm or in-house legal department, ideally in gaming, tech, media, or entertainment. Strong understanding of U.S. advertising laws (FTC Act, CAN-SPAM, TCPA, NAD decisions) and gambling regulations across regulated states. Experience reviewing promotional terms, sweepstakes/contest rules, and digital marketing materials. Familiarity with IP law, including trademark clearance, registration, enforcement, and content licensing, as well as publicity rights and NIL. Excellent communication skills and the ability to provide clear, actionable advice to cross-functional teams. Strong attention to detail, sound judgment, and business acumen. Preferred experience: Prior experience in a gambling, sports betting, or highly regulated industry. Knowledge of state-by-state regulatory nuances related to gaming and marketing. Familiarity with digital marketing tools, affiliate networks, and influencer compliance considerations.
