Intellectual Property Litigation Attorney
Working with the Firm's New York City Intellectual Property and Technology practice, lead and supervise the legal representation of national and international clients in complex intellectual property litigation matters, with a particular emphasis on representing clients in the pharmaceutical and biotechnology industries including litigating under the Hatch-Waxman Act in federal court. Assume significant responsibility for leadership of multiple projects. Provide legal advice regarding intellectual property disputes, including patent infringement and invalidity issues, and technologies in a variety of fields. Understand the underlying technology of clients' products and effectively explain the technologies and concepts at issue to a variety of non-technical audiences including judges, juries, and other attorneys. Help the Firm's clients prevail at every stage: on the pleadings, at trial, in settlements, and on appeal. Research, interpret and apply U.S. patent laws and foreign patent systems and laws. Develop and suggest substantive legal solutions that satisfy client's business objectives. Quickly spot the core issues involved in the matter and handle complex analysis. Draft substantive legal briefs and persuasive motions for both intellectual property and general litigation matters. Prepare pleadings, discovery requests and responses, subpoenas, motions, briefs, depositions, and oral arguments. Prepare original drafts that require minimal editing, cogently convey the arguments or the terms, and correctly discuss or incorporate all relevant precedent in a persuasive manner. Confidently articulate and defend complex positions. Anticipate and effectively deal with potential counter-arguments and issues. Engage and prepare technical experts and fact witnesses (e.g., inventors, researchers) for depositions, fact and expert discovery, and direct and cross examination at trial. Deliver oral presentations that effectively communicate complex information to different audiences. Provide leadership for internal and external business, practice and professional development activities. Direct team of junior and midlevel associates and paralegals. Allocate team resources, and assign and guide the team's work. Work hours will be spent approximately, as follows: 20% - Case/matter management; 20% - Client relations, and communications with co-counsel and opposing counsel; 15% - Discovery, depositions, and trial preparation; 10% - Team leadership, supervision, and development; 10% - Research, analysis, and writing; 10% - Technical analysis; 5% - Trial, pretrial preparation; 5% - Business and professional development, including thought leadership/client alerts 5% Other- e.g., pro bono advocacy, recruiting, etc. Requirements: Must be licensed to practice law in New York. Requires a Juris Doctorate (JD) from an ABA accredited law school and five years of experience as a counsel, associate, attorney, or law clerk in litigation practice with a multinational law firm. Qualifying experience must include at least 3 years as a licensed attorney representing national and global clients in high-stakes Intellectual Property litigation (seeking damages in excess of $10 million), including: representation of clients in the pharmaceutical and biotechnology industries, including litigating under the Hatch-Waxman Act in federal court; research, interpretation and application of U.S. patent laws and foreign patent systems and laws; drafting legal briefs involving issues related to intellectual property law at the district court level; drafting and litigating discovery requests, including discovery dispute motions; drafting legal memoranda, responsive briefs, and discovery requests for intellectual property litigation cases; drafting pleadings, motions to dismiss, summary judgment motions, claim construction briefs, and motions in limine; explaining underlying chemistry and biology concepts to a variety of audiences (e.g., judges, juries, and other attorneys); engaging and preparing technical experts and fact witnesses (e.g., inventors, researchers) for depositions, fact and expert discovery, and direct and cross examination at trial; and taking fact witness depositions. Requires excellent oral and written English communication skills. Regular office presence required, with flexibility to work remotely from home (within area of employment) on an as-needed basis, subject to business needs and manager approval. Based on client needs, incidental domestic and/or international travel of up to 10% may be required - e.g., for client meetings, business development, firm activities.
