While this position offers the potential for remote work within North Dakota, we prefer the candidate to work in person at our Bismarck office during the probationary period to support onboarding and team integration.
This position is responsible for collaborating with Insurance Department staff, criminal and civil investigators, and fellow attorneys to:
Prepare administrative and criminal cases for enforcement and prosecution Provide legal advice and opinions for the Commissioner, Deputy Commissioner, and other Department employees Advise agency staff on legal matters Draft legislation and legal documents Represent the Department in administrative hearings, legislative hearings, and civil court
This position is under the direction of the Department's General Counsel to provide a wide variety of legal support to the Department staff members. The ideal candidate for this position must enjoy collaborating and interacting with civil and criminal investigators, non-attorney subject matter experts, consumer protection professionals, and other attorneys. The Department values the ability to develop strong working relationships and collaborative work that produces optimum results.

Duties and Tasks
Collaborate with Department staff, criminal and civil investigators, and fellow attorneys to prepare administrative and criminal cases for enforcement and prosecution Educate Department staff about the law concerning insurance fraud and the business of insurance, and act as an insurance and criminal law resource Establish and maintain working relationships with the judiciary, other attorneys, county officials, and law enforcement Investigate, perform legal analyses, and summarize and brief insurance agent and company regulatory violations Conduct legal research relating to insurance fraud, the business of insurance, and administrative agency regulations Respond to insurance regulation inquiries from the public, the insurance industry, and others Respond to legal inquiries from North Dakota legislators and legislative council, and represent the Department during the regular legislative session and interim session at hearings and committee meetings Draft and assist other Department staff in drafting legislation and administrative rules Draft legal opinions, pleadings, motions, briefs, orders, search warrants, settlement agreements, and other legal documents Represent the Department and State in civil court, and administrative hearings in a competent, effective, and ethical manner Negotiate and settle civil, and administrative complaints Assist with regulatory examinations of insurance companies Coordinate work with state's attorneys, insurance regulators in other states, other North Dakota agencies, and federal agencies Keep up to date on state and federal insurance issues, case law, regulations, and practices Participate in national committee conference calls and meetings, including possible travel to national insurance regulation conferences and meetings Engage in education and training courses to become a competent insurance regulation resource Perform other duties as necessary and/or assigned by the Commissioner, Deputy Commissioner, and General Counsel
Minimum Qualifications
A Juris Doctorate degree Admitted to North Dakota Bar or eligible for North Dakota Bar admission by motion High ethical standards and a positive personnel history Excellent written and verbal communication skills
Preferred Qualifications
Preferred Experience or Demonstrate Ability to Learn Related Subject Matter:
Knowledge and application of state and federal regulatory law WestLaw research Legislative drafting Strong interpersonal skills needed to work well with clients, colleagues, government officials, and the public Good judgment, strong reliability, and a willingness to devote time and energy necessary to provide excellent services to the Insurance Commissioner and staff members Excellent time management and organization skills Experience with criminal law may be given preference
