Position Overview

This position is located in the Gallatin County Attorney's office and is responsible for prosecuting felony offenses in the district court, felony and misdemeanor offenses in the youth court, and misdemeanor offenses in the justice court, all under the direction of the Gallatin County Attorney. Essential Duties

Prosecutes criminal offenders, reviews investigative reports from law enforcement officers and makes determinations of what charges to file and who to charge or decline the prosecution. Prepares for and makes court appearances in non-trial settings such as arraignments, omnibus hearings, change of plea hearings, sentencing hearings, etc. Interviews and prepares witnesses. Prepares court papers. Responds to motions and arguments from the defense. Represents the State in court appearance before judges and juries. Prepares witnesses. Prepares jury instructions and exhibits. Examines witnesses. Negotiates plea agreements with defense counsel or defendants unrepresented. Assists law enforcement officers with search warrants and subpoenas. Does legal research and prepares legal briefs, memoranda and other documents. Advises city and county agencies and other special districts on legal questions pertaining to their functions. Expectation to be on-call at times to respond to law enforcement questions. Prepares legal documents for court. Negotiates with parties to resolve contested issues. Appears in court and handles regular court duties such as preparing witnesses, investigating evidence and witnesses, and preparing findings of fact, conclusions of law and preparing other arguments either orally or with written briefs. Other Duties As Assigned

Performs a variety of other duties as assigned by the County Attorney, the Chief Criminal Deputy Attorney and the Special Crimes Chief. Qualifications

This work requires knowledge of state and local statutes, rules, regulations and criminal procedures, and legal terminology and documents. The position also requires the ability to effectively communicate verbally and in writing; exercise courtesy and tact in receiving the public and in giving and obtaining information; and understand and maintain safeguards for sensitive and confidential information. Education & Experience

This position requires a degree from an accredited law school and an active membership in the State Bar of Montana. Two years of experience preferred. Supplemental Information

Excellent Medical Health Benefits – Group health benefits, including dental and vision coverage, are available to eligible County employees. The medical health benefits premium is covered for full-time employees. The County contribution is pro-rated on hours paid for part-time employees. The employee pays the premium portion for dependent coverage. Family health benefits coverage is $205.00 per pay period. Medical deductible is $400 for an individual and $1,000 for a family. Flexible Benefits Plan – Pre-tax out-of-pocket medical expenses and day care expenses. Supplemental Medical Coverage and voluntary Life Insurance Coverage are offered through Mutual of Omaha. Public Employees Retirement System – Montana public employees of the state, university system, local governments and certain employees of school districts are covered by the Public Employees Retirement System (PERS). New members to the PERS have an opportunity to choose between two retirement plan options: the Defined Benefit Plan or the Defined Contribution Plan. Sheriffs' Retirement System (SRS) – A public pension plan for all Montana Sheriffs hired after July 1, 1974 and Detention Officers hired after July 1, 2005. Supplemental Retirement Benefits are offered through Nationwide and Empower. Sick Leave – Full-time employees accrue 7.40 hours per month and are eligible to use sick leave once it is accrued. The accrual is pro-rated for part-time employees. Vacation Leave – Full-time employees accrue 9.20 hours per month and are eligible to use leave once it is accrued. The accrual is pro-rated for part-time employees. Holidays – The County observes eleven legal holidays in even numbered years and ten legal holidays in odd numbered years. Paid Parental Leave (PPL) – 240 hours of PPL to eligible full-time employees. The hours are pro-rated for part-time employees. Bilingual Pay - Gallatin County allows for bilingual pay to employees that provide translation services to County departments and offices.
