Macdonald & Company is excited to partner with one of the largest privately held, fully integrated real estate companies in appointing a Counsel – Commercial Leasing. The firm develops, operates, and owns a national portfolio of retail, office, hospitality, and industrial properties totaling more than 50 million square feet. This attorney will report to the Head of Legal – Leasing and will work closely with the internal leasing, development, and property management teams on approximately 25–30 office, warehouse, and retail transactions at any given time, ranging from mom-and-pop to regional and national tenants. The role is on-site, with relocation assistance available. Responsibilities
Negotiate leases, lease amendments, waivers, subordination agreements, estoppels, and termination agreements with tenants, attorneys, and brokers. Draft and revise leases and lease amendments for new and existing tenants. Collect information and exhibits from other departments for final lease review. Support the leasing team on lease documents executed with current or proposed tenants. Assist with prospective tenant proposals, including LOIs and reviewing restrictions. Review lease terms and statuses. Negotiate ancillary lease forms, such as waivers, subordination agreements, estoppels, termination agreements, and rental agreements. Draft and revise lease agreements, coordinating with internal departments to gather required exhibits and details, and provide implementation guidance to administrative teams. Provide lease interpretation support and respond to internal inquiries regarding lease obligations, commencement dates, and other terms. Assist in preparing purchase and sale agreements and support due diligence efforts through closing. Monitor lease obligations to ensure compliance with critical dates, exclusivity provisions, and restrictive covenants. Prepare post-execution documents, including waivers and tenant improvement allowance confirmations. Support the resolution of lease-related disputes, insurance claims, and tenant enforcement issues. Qualifications
J.D. from an accredited law school; active bar admission in Florida. Minimum of 5 years of experience practicing law, with specific knowledge of commercial real estate and commercial real estate leasing. Demonstrated experience in contract negotiations. Strong business acumen and excellent verbal and written communication skills. Proven ability to manage multiple real estate files efficiently and effectively. Proficiency in Microsoft Office applications. Seniority level
