Compensation Claims Referee (NY HELPS), WCB Item #3795
The Workers' Compensation Claims Referee will conduct hearings and render decisions on claims arising under the Workers' Compensation Law, Disability Benefits Law, Volunteer Firefighters Benefit Law, Volunteer Ambulance Workers' Law, and Paid Family Leave Act.
Key responsibilities include:
Conducting hearings and rendering decisions on claims
Ascertaining the substantial rights of the parties and evaluating evidence
Determining questions of fact and law, and making findings and decisions
Assisting claimants in the pursuit of their claims
Confering with claimants, representatives, and carriers at preliminary hearings
Directing reimbursement to disability benefit carriers and ordering medical examinations
Exercising discretion in determining the need for adjournment of cases
Presiding over discrimination hearings and cases involving noninsured employers
The ideal candidate will have five years of full-time, professional level legal experience, subsequent to admission to the New York State Bar, including three years of experience in the practice of Workers' Compensation Law or related fields.
