Affirm is looking for a thoughtful, collaborative, and skilled employment lawyer to join the Employment Legal and Ethics team as Senior Counsel, Ethics and Employment. This dual-hatted role is ideal for an employment attorney who is enthusiastic and comfortable navigating the complexities of both employment law and investigations, with primary responsibility for (1) managing the day-to-day operations of Affirm’s internal ethics program, including conducting ethics investigations, and (2) advising business partners on US employment legal matters generally (unrelated to ethics matters). Reporting to the Associate General Counsel, Employment & Ethics, you will join a small but mighty team and be in a position to drive impact quickly. What You'll Do
Manage vendor transition and Affirm’s whistleblower hotline and regularly prepare critical reports about hotline activity for different audiences
Conduct Ethics investigations fairly and consistently in a timely and professional manner, including preparing clear reports and delivering findings to internal stakeholders
Oversee and manage Affirm’s Code of Ethics and Business Conduct, including reviewing, drafting, and adopting policies, managing vendor translation (as needed), and collaborating with cross-functional teams on policy development (e.g., global expansion) and reviews
Develop solutions and apply Affirm’s policies to respond to Ethics inquiries relating to potential conflicts of interest, gifts and entertainment, and other inquiries from employees and job candidates
Build and prepare library of Ethics materials
Launch regular training and communications initiatives, including development of communications content
Employment Legal
Adhere to privilege protocols and provide pragmatic legal advice and guidance on US employment matters (unrelated to ethics matters), including, but not limited to, reasonable accommodations, leaves of absence, employee performance, separations, payroll tax, and employee benefits
Draft and/or review employment agreements, policies, and internal and external communications
Distill complex legal issues into helpful frameworks or reference guides for cross-functional partners
Collaborate and influence stakeholders through clear oral and written communications
As needed, negotiate and manage pre-litigation matters, administrative claims or audits, and litigation/arbitration, and outside counsel
Monitor legal developments and proactively educate key partners and Employment Legal team
Flex to proactively engage on special projects, which could include areas outside of main jurisdictions or subject matter expertise
What We Look For
J.D. from an accredited US law school and licensed and in good standing to practice law in a US state where Affirm has a stronger presence (e.g., California, New York, Washington, Texas)
Minimum of 3 years of relevant investigations and legal experience at a leading law firm, or combined with experience as in-house counsel
Solid knowledge of key US employment laws, including but not limited to, Title VII, ADEA, FCRA (in the employment context), FMLA, ADA, FLSA, EPA, NLRA, and state equivalents
Possess a high level of integrity and personal ethics
Laser focus on client-service excellence by being highly proactive, responsive, adaptable, and team-oriented
Demonstrated ability to develop solutions to complex legal matters without losing sight of business objectives
Outstanding organizational skills to handle multiple projects simultaneously between Ethics and Employment Legal and effectively prioritize deadlines
Excellent communication skills and attention to detail
A good sense of humor and intellectual curiosity; interest and experience using new technologies to drive scalable solutions

Equity Grade - 8
Base pay ranges: USA base pay range (CA, WA, NY, NJ, CT) per year: $215,000 - $265,000; USA base pay range (all other U.S. states) per year: $191,000 - $241,000. Visa sponsorship is not available for this position.
Affirm is remote-first; most roles are remote and you can work from anywhere in the country of employment. Some roles may require working from an Affirm office occasionally.
