Who We Are The Office of the General Counsel (OGC) is the legal team for the Department of Health and Human Services (HHS), providing quality representation and legal advice on a wide range of highly visible national issues. OGC supports the development and implementation of the Department's programs by providing the highest quality legal services to the Secretary of HHS and the organization\'s various agencies and divisions.
OGC is comprised of three principal subcomponents: the Immediate Office, Headquarters Divisions, and Regional Hubs for CMSD. The National Complex Litigation and Investigations Division (NCLID) is one of the Headquarters Divisions. The Centers for Medicare and Medicaid Division (CMSD) is another of the Headquarters Divisions with Regional Hubs in Philadelphia, Atlanta, Kansas City, and Denver.
Openings OGC is looking to fill multiple positions in its CMSD and NCLID Divisions.
NCLID
— serves as the in-house counsel for the Department at large, focusing on complex cases from across the HHS litigation portfolio. Cases include nationwide class actions, challenges to CMS program implementations, disputes over funding distributions, administrative litigation challenging OCR rules, First Amendment issues affecting the Department, and related investigations.
CMSD
— defends policies, regulations, and guidance issued by CMS. Openings include junior and senior attorney positions in the Program Integrity Group, Program Enforcement Group, Program Review Group, and Litigation Group.
Divisions and Groups
Program Integrity Group
— advises on fraud, waste, abuse, financial management, and program compliance; work areas include CMS Innovation Center models, drug pricing, and False Claims Act work.
Program Enforcement Group
— provides advice on enforcement of Medicare, Medicaid, and CHIP requirements; litigates before the Departmental Appeals Board (DAB); supports DOJ in federal court litigation.
Program Review Group
— provides complex legal counsel on significant regulatory and guidance documents, proposed legislation, and program initiatives including Medicare, Medicaid, CHIP, CLIA, insurance reforms, and health information exchange matters.
Litigation Group
— works with the Department of Justice to defend CMS actions in federal court; roles include lead and supporting attorneys in federal district and appellate courts on healthcare-related statutes and CMS regulations.
