Deputy District Attorney / Prosecutor III & IV – Monterey County District Attorney's Office. Recruitment for criminal and civil divisions. The office seeks experienced, ethical, public-service minded attorneys to seek justice and promote public safety on behalf of the people of Monterey County and the State of California. The District Attorney's Office is headquartered in Salinas with a satellite office in Monterey. The office includes 53 Deputy District Attorneys and operates in both criminal and civil divisions, handling a range of cases including felony, misdemeanors, juvenile matters, consumer protection, environmental crimes, cannabis enforcement, real estate fraud, asset forfeiture, weapon forfeiture, and other related work. The office supports training and is an MCLE provider. Responsibilities

Prepare and prosecute cases by presenting opening statements, examining witnesses, introducing evidence, making objections, arguing points of law, and presenting closing arguments. Research questions of law and evidence; apply statutory and decisional law, and other legal texts in case preparation. Attend scheduled court hearings including arraignments, pretrial hearings and motions, sentencing, probation revocations, and forfeiture proceedings. Prepare legal briefs, motions, and pleadings; interview victims, police officers, and witnesses; determine follow-up investigations needed for trial or settlement. Marshal, review, and prepare evidence for presentation in court, mediation, or other resolution proceedings; negotiate appropriate case dispositions without trial when appropriate. Evaluate requests for criminal or civil complaints; analyze evidence for sufficiency and determine if additional evidence is required. Advise the public and law enforcement on criminal and other matters affecting health and safety of consumers. May be assigned to train and/or serve as lead worker over less experienced attorneys. Qualifications and Knowledge/Skills/Abilities

Qualifications:

Pursuant to Section 6060 of the Business and Professions Code, current, valid membership in the California State Bar is required by date of hire. Knowledge/Skills/Abilities: Working Knowledge:

duties and powers of the Office of the District Attorney; ethical standards for prosecutors; legal research and writing; rules of evidence. Thorough Knowledge:

principles of criminal and civil law, criminal procedure, trial practice; California statutory, constitutional, and decisional criminal law. Skills/Abilities:

use a computer; gather and evaluate complex data; interpret statutes and legal precedents; orally communicate complex information; write clearly; organize and present complex material in court; evaluate sensitive situations; establish cooperative relationships; independently manage increasing caseloads; think creatively; train and review staff. Employment Conditions:

Successful completion of a thorough background investigation; on-duty response to law enforcement requests; ability to manage a heavy caseload and work extra hours; rotation between Salinas and Monterey offices/courthouses. Compensation and Benefits

Salary: Deputy District Attorney III: $10,132 – $13,773 monthly; Deputy District Attorney IV: $12,649 – $17,220 monthly. As of July 01, 2024, up to a $10,000 signing bonus may be offered to eligible regular full-time hires in this classification.
