The Office of General Counsel provides legal counsel to the Commission on all matters under the Commission’s jurisdiction. This office also supervises the procedural and legal aspects of all cases before the Commission and assists in responding to inquiries from the Legislature. The office defends Commission orders on appeal, defends Commission rules challenged before the Division of Administrative Hearings, and represents the Commission before state and federal courts. It supports FPSC offices and divisions in filings with or presentations to other federal, state, or local agencies. It advises in rulemaking and attends or conducts hearings. It reviews procurement contracts; counsels on personnel, contractual, public records, and other administrative legal matters. In cases involving evidentiary hearings before the Commission or an Administrative Law Judge, the office conducts discovery, presents staff positions and testimony, cross-examines witnesses, and, with technical staff, prepares recommendations and written Commission orders. The Senior Attorney
hired will work in the
Economic Regulation Section
of the Office of General Counsel. This section handles legal work for ratemaking, certification, and territorial issues in the water, wastewater, electric, and gas industries. The Senior Attorney will appear primarily before the Florida Public Service Commission. Applicants must have working knowledge of and experience with the Florida Administrative Procedure Act, the Uniform Rules of Procedures, Florida Civil Procedure, and the Florida Evidence Code. Applicants must be able to evaluate issues; conduct complex legal research and apply it; conduct investigations and discovery; present evidence; advocate positions at hearings both orally and in writing; communicate effectively verbally and in writing; and work collaboratively on a team. Minimum Qualifications
Admission to The Florida Bar and two years of professional experience in the practice of law, legal research, teaching law, or in administrative or judicial meetings. Background investigations, including criminal history record checks and education verifications, will be conducted on all applicants recommended for hiring.
