Job Description We are seeking an experienced Attorney with strong probate and guardianship litigation experience, who is also comfortable with estate planning and probate administration. You will lead contested matters including will/trust disputes, fiduciary issues, and guardianships while managing a docket of planning and administration matters.
Key Responsibilities Litigation
Handle contested matters: will/trust contests, undue influence/capacity claims, trust construction, removal/surcharge, accounting objections, breach of fiduciary duty, contempt/enforcement.
Manage guardianship matters: ETG petitions, examining committee coordination, incapacity hearings, annual plans/compliance, restoration/termination.
Draft and argue motions, take/defend depositions, conduct mediations and evidentiary hearings, and try bench trials.
Manage discovery, expert retention, exhibits, and witness preparation; negotiate settlements and consent orders.
Administration & Planning
Oversee formal and summary administrations, homestead determinations, creditor claims, and small estate strategies.
Provide trust administration guidance: notices, accountings, distributions.
Draft estate planning documents: revocable trusts, pour-over wills, powers of attorney, health care surrogates/HIPAA, living wills; prepare and record Florida deeds (including Lady Bird deeds when appropriate).
Coordinate with CPAs and financial advisors on tax and funding matters; manage trust funding checklists.
Meets or exceeds billable hour and collections targets.
Zero missed deadlines; court-ready filings and hearing preparation.
High client satisfaction (NPS/Google reviews) and proactive client communication.
Basic Qualifications
Member of the Florida Bar in good standing (required).
5+ years of probate/guardianship/trust litigation experience in Florida (bench trials and evidentiary hearings preferred).
Organized, team-oriented, and aligned with our core values.
Strong working knowledge of Florida Probate Rules, Rules of Civil Procedure, Rules of Evidence, and local administrative orders.
Preferred Qualifications
Spanish proficiency is a plus.
Excellent drafting, oral advocacy, and client communication skills; calm under pressure with practical, solution-oriented judgment.
Additional Information
Compensation: $140,000 - 220,000 annually
