Summary Federal Student Aid (FSA) is a principal office of the United States Department of Education responsible for awarding billions of dollars in federal student aid funds.

Duties GS‑905‑11

responsibilities:

Prepare preliminary memoranda/reports outlining facts and legal issues, analyze factual and legal issues, explain application of legal principles and precedents, and justify recommendations or conclusions.

Conduct research related to legal questions, including interpretation and application of statutes, rules, and regulations pertaining to enforcement matters.

Review and synthesize evidence to support legal theories.

Investigate and adjudicate borrower defense claims under close supervision.

GS‑905‑12

responsibilities:

Prepare preliminary memoranda/reports outlining facts and legal issues, analyze factual and legal problems, explain application of legal principles and precedents, and justify recommendations or conclusions.

Conduct research of statutes, regulations, ED and FSA policies, and legal opinions relevant to investigation activities and borrower defense decisions.

Gather, review, and analyze evidence to support case development.

Investigate or adjudicate borrower defense claims involving varied factual and legal issues.

Conditions of Employment

Relocation is not paid.

May be subject to one‑year probationary period.

Qualifications Applicants must meet all qualification requirements within 30 days of the closing date of this vacancy announcement. Current federal employees must satisfy time‑in‑grade and time‑after‑competitive‑appointment qualifications within 30 days of the closing date.

Minimum Qualifications for GS‑11

Active member in good standing of a U.S. state, territory, D.C., or Puerto Rico bar.

One year of professional legal experience equivalent to the next lower grade level.

OR a second professional law degree (LL.M.) or superior law school record as described below.

Alternatively, evidence of superior achievement in law school (e.g., top third of class, law review, Coif, moot court, legal aid program, clerkship).

Specialized Experience Required for GS‑11

At least one year of experience in federal or non‑federal service equivalent to GS‑09 performing at least two of the following duties: reviewing borrower defense claims, interpreting borrower defense regulations, legal research.

Minimum Qualifications for GS‑12

Active member in good standing of a U.S. state, territory, D.C., or Puerto Rico bar.

First professional law degree or equivalent training.

Two years of professional legal experience equivalent to the next lower grade level.

Specialized Experience Required for GS‑12

At least one year of experience equivalent to GS‑11 performing at least two of the following duties: analyzing and adjudicating borrower defense claims, reviewing borrower defense claims, interpreting regulations, analyzing evidence.

Education Education cannot be substituted for experience for this position and grade level.

Foreign education is accepted if comparable to a U.S. accredited institution. Applicants must provide a certificate of foreign equivalency.

Selection and Evaluation Applicants will be evaluated for this job based on how well they meet the stated qualifications. Evaluation will consider application materials, competency assessment results, and responses to the application questionnaire.
