About This Opportunity A well-established plaintiff-side employment law firm is seeking a Pre-Litigation Employment Attorney to join its Employment Department in California. The role focuses on the critical pre‑litigation phase of employment cases, where attorneys evaluate claims, draft compelling demand letters, negotiate settlements, and provide exceptional client service to employees seeking justice in workplace disputes. This position is ideal for attorneys with strong analytical skills, negotiation abilities, and a passion for advocating on behalf of employees who have experienced wage theft, discrimination, retaliation, wrongful termination, and harassment.
Key Responsibilities
Manage a dynamic caseload of pre‑litigation cases from initial intake through settlement, handling multiple matters simultaneously in a fast‑paced environment.
Analyze case facts comprehensively to assess liability, damages, and claim value, including reviewing personnel files, pay records, time‑keeping systems, and client documentation.
Draft detailed demand letters that articulate legal violations, present compelling factual narratives, and maximize settlement value for clients.
Collaborate with specialized internal teams, including Intake, Case Management, Demands/Negotiation, and Liens teams, to ensure seamless case processing and optimal outcomes.
Strategize the strongest possible pre‑litigation posture for each case, identifying key legal issues, developing persuasive arguments, and positioning cases for favorable settlements.
Negotiate settlements directly with employers, insurance carriers, and opposing counsel, advocating for clients’ interests and securing maximum compensation.
Maintain consistent communication with clients, providing regular updates, explaining legal processes, and offering guidance throughout the pre‑litigation process.
Ensure thorough documentation of all case notes, evaluations, and negotiation communications, maintaining accurate and organized case files.
Identify cases suitable for litigation, working with litigation teams to transition matters when settlement negotiations are unsuccessful.
Stay current on California employment law developments, including wage & hour regulations, FEHA protections, PAGA provisions, and evolving case law.
Qualifications
Juris Doctor (JD) degree from an accredited law school.
Active member of the California State Bar in good standing (required).
1–10 years of experience in employment law, with a strong understanding of California employment statutes and regulations.
Pre‑litigation, intake, demand, or negotiation experience is a significant plus, demonstrating proficiency in the specific skills required for this role.
Strong knowledge of California employment laws, including wage & hour laws, FEHA, wrongful termination, PAGA, CFRA, and other leave laws.
Excellent negotiation skills, with the ability to advocate persuasively for clients and secure favorable settlement terms.
Outstanding legal writing and analytical abilities, capable of drafting compelling demand letters and case evaluations.
Strong client communication and interpersonal skills, with empathy, patience, and the ability to explain complex legal concepts clearly.
Ability to thrive in a fast‑paced, high‑volume environment, managing multiple cases simultaneously while maintaining high‑quality work product.
Ability to work independently while collaborating effectively with internal teams and colleagues.
