Job Summary The Assistant City Attorney – Transactional is a member of the City Attorney's Office, reports to and is under the authority of the City Attorney. General responsibilities include research and drafting of legal opinions, litigation, and legal advice as requested. Due to the wide scope of legal opinions and related work to which attention must be given; there is much need for independent judgment with a high degree of responsibility. Incumbent in this classification may also be assigned as City Prosecutor, which requires extreme independent judgment and ability to prosecute municipal offenses successfully without direct supervision. This position will be assigned to support various City departments as determined by the City Attorney and assist other transactional attorneys when requested.

Essential Job Functions And Responsibilities

Researches legal issues as directed by the City Attorney.

Drafts legal opinions for Department Heads and City Commissioners.

Researches and drafts ordinances and resolutions for presentation to the City Commission.

Prosecutes municipal ordinance violations in County Court and handles related appeals.

Provides advice to Planning and Zoning Board, Board of Appeals and Adjustment, Community Redevelopment Advisory Board, and General Employees’ Pension Board.

Prosecutes and defends City's actions before Civil Service Board.

Effectively and positively represents the City in delivering and performing work with colleagues and clients, irrespective of gender, race, religion, age, disability, political affiliation or belief, or sexual orientation.

Establish and maintain effective and professional relationships with work colleagues, supervisors and managers.

Performs related work as requested for this position description only.

Education & Experience Required

Graduation from an accredited law school (LLB or JD Degree) and membership in good standing in the Florida Bar. At least three (3) years of experience with research and drafting of legal opinions; providing legal advice; research and drafting of ordinances and resolutions; drafting and review of contracts; and providing presentations to City boards relating to Sunshine Law. Experience and expertise in a variety of legal matters, including drafting and review/revision of construction contracts, a general familiarity with government procurements, as well as experience with and knowledge of general municipal law is also required.

Additional education and experience or an equivalent combination of training and experience may be substituted for the above requirements.

Certificates, Licenses, Registrations

Membership in good standing in the Florida Bar

Valid Driver’s License: With proof of automobile insurance

Background Check: Must have an acceptable background record

Driving Abstract: Must have an acceptable driving record

Knowledge, Skills, Abilities

Knowledge of Federal, State, County, and municipal laws and regulations.

Knowledge of specific laws relating to planning and zoning, employee pension and civil service.

Skill in researching and analyzing day to day problems.

Skill in communicating effectively orally and in writing.

Ability to logically research and present alternate solutions to complex problems.

Ability to establish and maintain effective working relationships with City officials and employees, City Commissioners and outside legal counsel.

Ability to make presentations before elected bodies and commissions.

Ability to establish and maintain effective and professional relationships with work colleagues, supervisors, managers and the public.

Examination: Depending on the number of applicants and the quality of their education and experience, the examination may consist of one or more of the following tests: written examination, performance examination, education and experience evaluation, oral examination and/or other job related examinations. Repeated participation in any examination for which the same test is used is limited to once every 6 months. Your examination results will be sent by email as soon as possible after the grading is completed.

Additional Information All successful applicants will be required to pass an extensive background which may include criminal history searches, driving history checks, credit report, courthouse searches, education verification, employment verification, professional license verification, or other search methods as deemed necessary for the position. In addition, the applicant will be required to undergo a medical examination, which may include a drug screening, prior to appointment.

Employment of Relatives

The relative must have competed in an appropriate examination process as determined by Human Resources and be placed on a civil service eligibility list;

The relative must be among the top three ranked candidates available on the certified eligibility list unless expanded by the Civil Service Board;
