POSITION SUMMARY
An employee in this position performs professional and technical work in the management and administration of safety and risk management activities and ensuring adherence to the Americans with Disability Act (ADA) for the Legal Department of Harnett County. This includes managing the County's risk exposure; ensuring that employees are working in as safe environment as possible; administering the drug testing policy; overseeing the safety training program; and managing the County's ADA compliance program.
Hiring Range: $62,763.00 - $72,962.00 DUTIES AND RESPONSIBILITIES
ESSENTIAL FUNCTIONS OF THE POSITION: Consults with County managers, supervisors, and other employees to analyze training needs and areas for performance improvement and recommends preferred methods of achieving cost-effective solutions to hazards in workplace; responds to safety questions and concerns; identifies hazardous equipment, operations, and environments; recommends solutions to minimize; assists in the re-engineering process and conducts inspections and surveys on occupational health and safety conditions. Evaluates and maintains the property and casualty coverage for the County; handles liability claims and serves as liaison to the carrier; and answers questions from the public on claims against the County. Reviews insurance policy terms and conditions which fit the needs of the County including special endorsements; maintains records of all insurance contracts provided throughout the County. Develops loss control programs and instruction geared toward eliminating losses of property and equipment. Processes Workers' Compensation claims and property and liability claims; communicates with employees and citizens involved in accidents or claims; and communicates with insurance carrier staff adjusters, and legal counsel. Works with Finance staff to evaluate coverage for Workers' Compensation, buildings/property, equipment, and general liability; looks for savings or elimination of duplication of coverage. Provides information to legal representatives involved in lawsuits on liability or Workers' Compensation issues; and attends mediations as required. Consults with County Management, as required, regarding specific insurance related questions, the risk management program, objectives, and goals; keeps management informed of various aspects of current and planned operations and services in order to identify those activities, conditions, or situations which may create a risk of loss of property or injury to employees or the citizens of the County. Analyzes and evaluates such risks in order to determine their significance to the economic welfare of the County and the extent to which they can be eliminated or minimized. Coordinates, investigates, and negotiates all claim settlement agreements involving property damage, employee injury, or third-party liability. Determines and recommends the appropriate risk management technique to transfer or reduce risk to the County by retention, self-insurance, or purchase of insurance. Manages all administrative functions of the risk management program including review of certificates of insurance. Prepares an Annual Risk Management Report summarizing the risk management program including objectives and accomplishments to report to the Senior Staff Attorney and County Manager. Provides management oversite to the County's safety programs and procedure to ensure compliance with federal and state OSHA regulations; maintains records and logs documenting training and accidents; and coordinates ongoing safety and health programs/projects which include ensuring contractor safety compliance. Develops and maintains standards for insurance related matters; keeps current with changes in laws, rules, and regulations. Ensures the County's drug and alcohol policies are current and amended to reflect latest law, rule and regulation. Investigates workplace accidents and incidents involving employees or County property; reviews and evaluates accident and injury records and reports; identifies trends; monitors loss potential; ensures compliance with policies and procedures; and makes recommendations for corrective action. Develops and administers drug and alcohol testing programs required by DOT for employees with Commercial Drivers Licenses as well as testing for applicants for general safety sensitive positions. Arranges for and coordinates scheduling of insurance inspections and OSHA inspections with department directors and supervisors as required to determine compliance with applicable safety rules and regulations, including federal and state Occupational Safety and Health Administration regulations; advises supervisory or management personnel of steps necessary to resolve discrepancies. Plans, organizes, supervises, and conducts extensive County-wide safety training programs, which include topics pertaining to personnel, buildings, facilities, equipment, and work sites; coordinates activities with Fleet Safety Management Program; chairs meetings and providing input and direction based on expertise in work-place safety policies and procedures; prepares drafts of safety policies; and advises management as to requirements and procedure. Maintains records of claims and experience related to risk management activities, prepares related claims' report. Serves as designated ADA coordinator for the County. Oversees and leads the ADA compliance program to ensure the County's compliance with all aspects of Title II of the ADA, including, but not limited to, accessibility of public services, programs, and facilities. Creates and maintains clear, accessible guidelines regarding ADA rights and responsibilities. Conducts investigations in response to ADA grievances and complaints. Develops and implements policies and procedures related to accessibility, including those related to reasonable modifications. Develops and delivers Title II-related training on ADA requirements and best practices for internal and external stakeholders. Participates in new employee orientation. Assists department heads, supervisors, and employees and applicants with questions and concerns. Performs other related duties as assigned. MINIMUM QUALIFICATIONS
MINIMUM REQUIREMENTS TO PERFORM WORK:
Bachelor's degree in business administration, or related field, public administration, insurance, risk management, industrial hygiene, or a related field; Three (3) years of work experience in administration of insurance/risk management/safety programs Two (2) years of relevant experience with ADA compliance, investigation, or enforcement Or equivalent education and/or experience; Possession of a valid North Carolina driver's license; and Risk management/insurance industry professional training/designation such as Associates in Risk Management (ARM-P), Commercial Property Casualty Underwriter (CPCU), Certified Public Risk Official, Certified Safety and Health Manager, and OSHA 30-hour General Industry Certification desired. KNOWLEDGE, SKILLS, and ABILITIES: Knowledge of safety and risk management program development, services, activities, and administration. Knowledge of applicable federal and state workplace safety and environmental regulations, especially OSHA standards. Knowledge of Workers Compensation and related statutes and rules. Knowledge of the ADA and best practices. Skill in communicating effectively, both orally and in writing. Ability to analyze working conditions to determine unsafe work practices and recommend alternative methods and procedures. Ability to recommend and implement goals, policies, and procedures for effective and efficient safety and risk management services. Ability to analyze accident and risk trends to ensure the County is minimizing its risk exposure while effectively maintaining costs. Ability to establish and maintain effective working relationships with governmental agencies, employees, and the public Ability to enforce safety regulations with firmness and tact. Ability to prepare clear and concise administrative and financial reports. Ability to interpret applicable federal and state workplace safety and environmental regulations, especially OSHA standards. Ability to provide guidance and to facilitate the resolution of grievances/complaints related to ADA compliance.
SUPPLEMENTAL INFORMATION
PHYSICAL DEMANDS: Must be able to perform light work frequently exerting up to 10 pounds of force to lift, carry, push, pull, or otherwise move objects; and occasionally requiring to exert up to 20 pounds of force to move objects. This work also involves the physical abilities of balancing, climbing, crawling, crouching, feeling, grasping, perceiving sounds at normal speaking levels, kneeling, using mental acuity, pulling, pushing, reaching, performing repetitive motion, speaking, standing, stooping, expressing ideas by the spoken word, walking and driving. An incumbent must also possess the visual acuity to prepare and analyze data/statistics, operate a computer terminal, do extensive reading, and make visual inspections of work areas regarding safety standards. WORK ENVIRONMENT: The employee normally works in an office environment but may be subject to various inside/outside environmental conditions at various County work and accident sites.
