Deputy Prosecuting Attorney General Summary
Represents the State of Idaho as a trial attorney in the prosecution of criminal, quasi-criminal, and civil actions in Juvenile, Magistrate, and District Court proceedings. Assists the Elected Prosecuting Attorney in performing all statutory and constitutional functions of the Prosecuting Attorneys Office. This classification includes five levels, assigned based on organizational needs, experience, skill, and caseload complexity. Positions may be filled externally or through internal advancement. Progression is at the discretion of the Elected Prosecuting Attorney, provided minimum qualifications are met. Attorney Classification Levels
Level 1:
Law clerks and entry-level legal professionals, such as interns prior to passing the Idaho Bar. Usually work under immediate supervision. Level 2:
Attorneys handling misdemeanor or juvenile matters, indigent adult clients, child protection, and competency issues. Must have 1-2 years of experience. Generally work under general supervision. Level 3:
Attorneys handling low to mid-level felony cases and civil matters. Must have 3-4 years of experience. Usually work under general to limited supervision. Level 4:
Attorneys handling high-level felony cases and civil matters. Must have at least 5 years of experience, especially in trial and litigation. Usually work under limited supervision and supervise Level 1-3 Attorneys. Level 5:
Chief Deputy, appointed by the Elected Prosecuting Attorney. Handles highly complex civil or criminal matters, with at least 3 years of experience. Supervises all levels and staff under limited supervision. Essential Functions (Illustrative Only)
The duties include, but are not limited to: Performing all duties of a Prosecuting Attorney as per Idaho Code, managing cases from intake to disposition. Reviewing law enforcement reports to determine charges. Researching legal issues and preparing legal documents. Negotiating case resolutions. Preparing legal strategies, questions, jury instructions, and statements. Trial preparation, witness interviews, and evidence presentation. Screening cases and assisting law enforcement with warrants. Additional Details
