The Legal Aid Society’s Criminal Defense Practice is seeking an experienced attorney for the position of Citywide Decarceration Staff Attorney with the Decarceration Project. This innovative unit reimagines how public defenders confront pretrial detention through strategic litigation, policy advocacy, and early intervention, aiming to ensure clients return to their communities after arrest. Attorneys in the Decarceration Project are experts on bail and pretrial detention, litigating related matters with systemic impact, providing complex release advocacy, developing practice resources, and monitoring detention trends to inform policy and litigation strategies. The Citywide Decarceration Staff Attorney will collaborate with borough-specific attorneys to litigate pretrial detention cases and advance the unit’s litigation goals. They will also identify systemic issues, support policy advocacy, and develop citywide resources and training programs. Candidates should have deep knowledge of NYC criminal trial practice, extensive on-the-ground experience, and a demonstrated commitment to the liberation of incarcerated individuals and abolition. Essential Duties and Responsibilities
Challenge adverse pretrial detention decisions through litigation and advocacy Identify and develop precedent-setting cases Monitor legal and policy changes affecting pretrial detention Support systemic advocacy and stakeholder discussions Develop and update legal resources and conduct trainings Participate in professional development and promote an inclusive work environment Salary and Benefits
