Ensure compliance with the Texas Medical Practice Act, Texas Administrative Code, and other applicable laws. Will serve as a neutral and confidential resource and the primary point of contact for receiving, reviewing, and resolving complaints, inquiries, and concerns from the public, licensees, and stakeholders while promoting trust, transparency, accountability, and fairness. This position does not act as an advocate for any party and will ensure that all issues are treated with confidentiality and all individuals are treated with respect and in accordance with all applicable laws, rules, regulations, and agency policies. This position reports directly to the Executive Director and may perform advanced (senior-level) mediation work. Works under minimal supervision with considerable latitude for the use of initiative and independent judgment. Qualifications: Principal Duties: 20% Serves as primary point of contact for complainants, licensees, and members of the public seeking information or assistance regarding the agency's regulatory processes in investigations, licensures, and enforcement actions. Receives, reviews, and analyzes inquiries and/or complaints involving potential Medical Practice Act and agency rules and regulations complaints related to agency decisions, services, or procedures. Will prioritize and resolve issues and complaints by initiating investigations, conducting research, and explaining laws, rules, regulations, policies, and procedures. May facilitate informal resolution of concerns or misunderstandings through communication, clarification, or referral to appropriate agency staff. May escalate matters to the executive team when systemic concerns or policy gaps are identified. 20% Receives, assesses, composes, and responds to inquiries and complaints related to agency procedures, processes, and decisions. Gives neutral responses by providing explanations and interpretations of applicable statutes, rules, regulations, polices, and procedural options 20% Oversee the tracking and documentation of complaint trends to identify opportunities for rule making and/or policy to improve process improvements. May prepare reports and recommendations that identify recurring trends, barriers, or areas of improvement to improve agency services. May review investigative reports and case files involving potential violations of the Medical Practice Act and agency rules and regulations. May collaborate with general counsel, investigations, compliance and enforcement to protect public health and uphold professional standards. 20% Requests, reviews, and organizes supporting documentation to determine whether applicable information is received. Provides legal interpretations of relevant statutes, rules, and precedents and may provide input in drafting rule amendments and policy recommendations based on recurring trends involving the Texas Medical Practice Act. 20% Advises the Executive Director and agency staff on legal sufficiency of complaints and appropriate enforcement action and ensures timely processing of enforcement actions in accordance with statutory deadlines and agency timelines. Must maintain the confidentiality and neutrality of the requirements of the ombudsman function, while upholding transparency in reporting systemic issues. Knowledge, Skills, and Abilities: Knowledge of the Texas Medical Practice Act, the Administrative Practice Act and/or Texas Rules of Civil Procedure Demonstrated interest in legal principles and practices of law related to the administrative law and the licensing and regulation of professionals, specifically licensees engaged in health care Knowledge in conducting investigations and mediation and skill in dispute resolution Strong interpersonal and communication skills, with the knowledge to explain complex policies, rules, and regulations in clear and plain language Skills in analytical skills to identify patterns, systemic issues, and potential solutions Ability to analyze and prepare documents, reports, and correspondence; to conduct research; to recognize problems and identify and facilitate solutions; and to communicate effectively Ability to facilitate difficult conversations and to remain neutral, objective, and respectful in interactions Ability to interpret and apply laws Ability to conduct research and prepare cases Ability to communicate effectively both orally and in writing Ability to effectively manage multiple duties, set and meet deadlines Ability to maintain confidentiality Ability to work effectively in a team environment Experience and Education: Graduation from an accredited four-year college or university with major coursework in business administration, psychology, sociology, law (if law degree, must be licensed to practice law in Texas and be in good standing) or a related field is preferred. Experience and education may be substituted for one another. Experienced in dispute resolution, regulatory affairs, public policy, administrative law, or related work is preferred Experience working with complaints, investigations, or disciplinary processes in a governmental regulatory state agency or healthcare setting is preferred Experience in analyzing and prepare documents, reports, and correspondence; to conduct research; to recognize problems and identify and facilitate solutions is preferred Training or certification in mediation, ombudsman practice, or conflict resolution is preferred Work Environment Requirements: If temporary working remotely due to limited office space, applicant must have a dedicated, quiet, and secure workspace that ensures privacy and minimal distractions to maintain confidentiality while working remotely. If temporary working remotely due to limited office space, an applicant must have reliable and secure high-speed internet access with a minimum of 20 MBPS download and 2 MBPS upload. Applicants may be required to provide confirmation from the area ISP. All applicants must be familiar with or have a willingness to learn Microsoft suite (e.g. Word, PowerPoint, SharePoint, Excel, and Microsoft Teams).
